About approval of the Regulations on carrying out certification of the government civil servants

Based on Item 7 of article 41 of the Law of the Republic of Belarus of June 1, 2022 "About public service" the Council of Ministers of the Republic of Belarus DECIDES: No. 175-Z

1. Approve Regulations on carrying out certification of the government civil servants it (is applied).

2. This resolution becomes effective since September 1, 2022.

Regulations on carrying out certification of the government civil servants

1. This Provision determines procedure for carrying out certification of the government civil servants (further – civil servants).

Action of this provision does not extend much carrying out certification of the civil servants holding the state civil positions (further – civil positions) included in the personnel register of the Head of state of the Republic of Belarus, judges of courts of law, public prosecutor's workers, civil servants of customs authorities.

2. For carrying out certification the certifying commission which members affirm the decision, the order (order) of the head state organa* is created. The certifying commission can be permanent or be created for carrying out certification taking into account category of the civil servants who are subject to certification.

* State bodies are understood as also public institutions and other state organizations providing activities of the President of the Republic of Belarus or state bodies which employees according to the legal acts fixing their legal status are civil servants.

3. The certifying commission consists of the chairman who is, as a rule, one of deputy managers of state body, the vice-chairman, the secretary and other members.

Heads of structural divisions, employees of personnel service and other officials of state body are part of certifying commission, and also leading employees of higher and other state bodies can join.

Members of certifying commission have the equal rights in case of decision making.

In case of certification of the civil servant who is the member of certifying commission, its membership in this commission stops.

4. The basis for carrying out certification of civil servants is the decision, the order (order) of the head of state body which the schedule of carrying out certification affirms.

The schedule of carrying out certification affirms annually (on half-year).

In graphics of carrying out certification the civil servants who are subject to certification (further – certified), terms of its carrying out, the officials responsible for preparation of the documents provided in part one of Item 6 of this provision, and for representation certified at meeting of certifying commission are specified.

5. The decision, the order (order) on certification is brought to the attention certified not later than one month prior to certification.

6. On everyone certified not later than 20 calendar days prior to certification in personnel service the certification characteristic signed by the head of the structural unit (the head of state body or his deputy) is submitted. According to the decision of the head of state body for certified other materials reflecting results of its activities can be represented.

The certification characteristic shall contain objective assessment of practical activities certified, the level of its professional knowledge, legal culture, ability to work with people. The certification characteristic may contain recommendations about increase in efficiency of practical activities and the skill level certified to stimulation of its professional growth.

The personnel service not later than 15 calendar days before carrying out certification provides acquaintance of the civil servant with the certification characteristic provided on it.

In case of disagreement with the certification characteristic the civil servant has the right within 5 calendar days from the date of acquaintance with it to submit in personnel service the application addressed to the chairman of certifying commission for the disagreement with the certification characteristic with additional data on the professional activity or to state the reasons of the disagreement at meeting of certifying commission.

The personnel service not later than 10 calendar days prior to certification sends to certifying commission on everyone certified the certification characteristic, the reference fact sheet, the draft of the appraisal sheet for form according to appendix and other materials reflecting results of activities of the civil servant (in the presence).

In case of each subsequent certification in certifying commission the appraisal sheet with results of the previous certification of the civil servant is submitted.

7. Certification is carried out on condition of participation in meeting of certifying commission of most of her members.

8. The certifying commission carries out certification in the presence of certified, the head of the relevant structural division or other official responsible for representation of the civil servant at meeting of certifying commission.

By results of certification the certifying commission secret vote accepts one of the following decisions:

about compliance to the held civil position;

about incomplete compliance to the held civil position and repeated certification;

about discrepancy to the held civil position.

9. The solution of certifying commission is deemed accepted if most of the members of the commission who are present at meeting voted for it.

In case of the equal number of votes of members of the commission in case of acceptance at meeting of certifying commission of two versions of the decisions specified in part two of Item 8 of this provision, the decision is made for benefit of certified.

In case of the equal number of votes of members of the commission in case of acceptance at meeting of certifying commission of three versions of the decisions specified in part two of Item 8 of this provision concerning certified the decision on its incomplete compliance to the held civil position and repeated certification is made.

Results of certification appear certified directly after vote.

10. Repeated certification is carried out according to the procedure, determined by this Provision not earlier than in 6 months and not later than in 18 months from the date of carrying out certification.

The certifying commission by results of repeated certification accepts one of the following decisions:

about compliance to the held civil position;

about discrepancy to the held civil position.

11. The certifying commission makes the certified recommendations about increase in performance excellence of service duties.
