About consumer cooperation (consumer societies, their unions) in the Russian Federation

This Law guarantees to consumer societies and their unions taking into account their social importance, and also to the citizens and legal entities creating these consumer societies and their unions, the state support.

The relations arising in the field of creation and activities of consumer societies and their unions are regulated by the Civil code of the Russian Federation, this Law, other laws and other regulatory legal acts of the Russian Federation.

Chapter I. General provisions

Article 1. Basic concepts

For the purposes of this Law the following basic concepts are used:

consumer cooperation - system of the organizations of consumer cooperation created for the purpose of satisfaction of material and other needs of their members;

consumer society - the voluntary consolidation of citizens and (or) legal entities created, as a rule, on territorial sign on the basis of membership by consolidation by his members of property shares for trading, procurement, productive and other activity for the purpose of satisfaction of material and other needs of his members;

the district, district, regional, regional, republican, central union of consumer societies (further also - the union) - voluntary merging of consumer societies based on decisions of general meetings of consumer societies;

the district union of consumer societies - the union of consumer societies of the area created by consumer societies for coordination of their activities, ensuring protection of property and other rights of consumer societies and their members, representation of their interests in state bodies and local government bodies and also for rendering legal, information and other services to consumer societies. Decisions of governing bodies of the union on the questions determined in the charter of this union are obligatory for the consumer societies which are his members;

the district, regional, regional or republican union of consumer societies (further also - the regional union) - the voluntary merging of consumer societies of the autonomous area, area, edge or republic and (or) the district unions of consumer societies created on territorial sign for the purpose of coordination of activities of consumer societies and district unions of consumer societies, ensuring protection of property and other rights of consumer societies and their members, the district unions of consumer societies, representation of their interests in state bodies and local government bodies and also for rendering to consumer societies and district unions of consumer societies of legal, information and other services. Decisions of governing bodies of the union on the questions determined in the charter of this union are obligatory as for the consumer societies which are his members, and for the relevant district unions of consumer societies;

the central union of consumer societies of Russia (further also - the central union) - voluntary merging of consumer societies and (or) regional unions more than a half of subjects of the Russian Federation which acquired in accordance with the established procedure the right to use in the name of the word "Russia" and created for coordination of activities of consumer societies, unions of consumer societies, ensuring protection of property and other rights of consumer societies and their members, the unions of consumer societies, representation of interests of consumer societies, unions of consumer societies in state bodies, local government bodies and the international organizations and also for rendering to consumer societies and their unions of legal, information and other services. Decisions of governing bodies of the central union of consumer societies of Russia on the questions determined by the charter of the central union are obligatory as for his members - consumer societies and the regional unions, and for created by members of the central union - consumer societies of the district unions of consumer societies and the regional unions;

the organizations of consumer cooperation - consumer societies, the unions of consumer societies, and also organizations, economic societies and other legal entities whose single founders are consumer societies or the unions;

control and auditing management of the union - the structural division of the union of consumer societies performing conducting checks of organization activity of consumer cooperation according to board decisions of the union;

the unitholder, the member of consumer society - the citizen, the legal entity who contributed introductory and share and accepted in consumer society in the procedure established by the charter of consumer society;

the cooperative site - the site (part of consumer society) in which certain number of unitholders is integrated and which can be created, as a rule, on the territorial sign determined by the charter of consumer society;

the representative of consumer society - the unitholder elected at meeting of unitholders of the cooperative site and given authority to resolve issues on general meeting of representatives of consumer society. the admission fee - the sum of money directed to covering of the expenses connected with the accession to consumer society;

share - property fee of the unitholder in share fund of consumer society the money, securities, the parcel of land or land share, other property or property or other rights having money value;

share fund - the fund consisting of the shares brought by unitholders during creation of consumer society or the introduction in it and which are one of sources of forming of property of consumer society;

the reserve fund - fund which is intended for covering of losses from force majeure and procedure for forming and which use is determined by the charter of consumer society or union;

indivisible fund - part of property of consumer society or union which is not subject to alienation or distribution between unitholders and procedure for forming and which uses it is determined by the charter of consumer society or union;
