About procedure accreditation bodies of state members of the Eurasian Economic Union of mutual comparative estimates

According to item 4 of article 54 of the Agreement on the Eurasian Economic Union of May 29, 2014 and within realization of Item 4.5.1 of the Strategic directions of development of Eurasian economic integration till 2025 approved by the Decision of the Supreme Eurasian economic council of December 11, 2020 No. 12, of Item 4.5.1 of the actions plan on realization of Strategic directions of development of Eurasian economic integration till 2025 approved by the order of Council of the Eurasian economic commission of April 5, 2021 No. 4, and Item 25 of the actions plan ("road map") on elimination of withdrawals and restrictions in the domestic market of the Eurasian Economic Union for 2021 - 2022 approved by the Decision of Council of the Eurasian economic commission of October 5, 2021 No. 106, Council of the Eurasian economic commission solved:

1. Approve the enclosed Procedure by accreditation bodies of state members of the Eurasian Economic Union of mutual comparative estimates.

2. Ask the governments of state members of the Eurasian Economic Union to provide implementation of mutual comparative estimates by accreditation bodies since 2023.

3. This Decision shall enter into force upon the expiry of 30 calendar days from the date of its official publication.

Procedure accreditation bodies of state members of the Eurasian Economic Union of mutual comparative estimates

1. This Procedure determines rules of implementation of state members of the Eurasian Economic Union by accreditation bodies (further respectively - accreditation bodies, state members) mutual comparative estimates for the purpose of achievement of equivalence of the applied procedures concerning the accredited bodies for assessment of conformity included in the unified register of conformity assessment bodies of the Eurasian Economic Union.

2. The concepts used in this Procedure are applied in the values determined by the Protocol on technical regulation within the Eurasian Economic Union (appendix No. 9 to the Agreement on the Eurasian Economic Union of May 29, 2014 (further - the Agreement)) and the Protocol on recognition of results of works on accreditation of conformity assessment bodies (appendix No. 11 to the Agreement).

3. Accreditation bodies when implementing mutual comparative estimates provide comparability of results of fulfillment of requirements of the Agreement and acts of bodies of the Eurasian Economic Union in the field of accreditation and assessment of conformity, current versions of interstate standards in the field of the accreditation and assessment of conformity developed on the basis of current versions of international standards, and also documents of the International organization for accreditation of laboratories and the International forum on accreditation.

4. Mutual comparative estimates are performed concerning each accreditation body of 1 times in 4 years (with interval between mutual comparative estimates concerning accreditation body of one state member and accreditation body of other state member at least 6 months) and include:

a) the analysis of procedures of accreditation body by means of assessment of regulatory legal acts of state member in the field of accreditation and assessment of conformity and documents of system of management of accreditation body (further - documentary assessment);

b) observation (including remotely) behind carrying out by accreditation body assessment procedures of the conformity assessment bodies accredited by it (certification bodies, test laboratories (centers), bodies of inspectorate) included in the unified register of conformity assessment bodies of the Eurasian Economic Union (further respectively observation, conformity assessment bodies).

5. For the purpose of implementation of mutual comparative estimates by the Council of heads of accreditation bodies of state members of the Eurasian Economic Union operating according to the Regulations on Council of heads of accreditation bodies of state members of the Eurasian Economic Union approved by the Decision of the Supreme Eurasian economic council of May 14, 2018 No. 5 (further - Council of heads):

a) the schedule of implementation of mutual comparative estimates is determined (further - the schedule);

b) the structure of group on implementation of mutual comparative assessment is created (further - group on assessment) (for each accreditation body);

c) document forms, mutual comparative estimates, necessary for implementation (the questionnaire of self-assessment (further - the questionnaire), declarations on confidentiality and impartiality (further - the declaration), the report on results of documentary assessment, the report on results of observation, the closing statement on results of mutual comparative assessment are determined (further - the closing statement), etc.);

d) the list of conformity assessment bodies for observation is determined (for each accreditation body) (further - the list of conformity assessment bodies);

e) the closing statement and recommendations about corrective actions (further - recommendations) are approved (if necessary).

6. For the purpose of forming of the schedule members of council of heads present to the responsible secretary of Council heads of the offer on dates group on assessment of mutual comparative assessment.

7. For the purpose of forming of structure of group on assessment members of council of heads present to the responsible secretary of Council heads of the offer on candidates for inclusion in structure of group on assessment (on 4 employees having necessary competence and professional skills from accreditation bodies which heads are members of council of heads).

Groups on assessment are not included the staff of accreditation body concerning which mutual comparative assessment is performed.
