About some questions of state regulation of seed farming and strain testing

The Council of Ministers of the Republic of Belarus DECIDES:

1. Approve enclosed:

Regulations on supervision in the field of seed farming;

Regulations on procedure for carrying out the state testing of grades, procedure for inclusion of grades in the state register of grades, their exceptions of this register and procedure for its maintaining;

2. Declare invalid the resolution of Council of Ministers of the Republic of Belarus of August 11, 1997 No. 1047 "About organization-legal actions for accomplishment of the Law of the Republic of Belarus "About seeds" (Collection of decrees, presidential decrees and orders of the Government of the Republic of Belarus, 1997, Art. No. 22-23, 805).

3. This resolution becomes effective from the date of its acceptance.

Regulations on supervision in the field of seed farming

2. The main objectives of supervision in the field of seed farming are ensuring compliance by republican state bodies, local executive and administrative organs, legal entities and physical persons, including individual entrepreneurs, regulatory legal acts, including the technical regulatory legal acts obligatory for observance in case of production, processing, procurement, storage, transportation, realization and use of seeds.

3. Supervision in the field of seed farming is exercised for:

observance of requirements of technical regulatory legal acts in case of production, processing, procurement, storage, transportation, realization and use of seed (landing) grain of all cultures growing in the territory of the Republic of Belarus;

registration and approbation of high-quality crops, carrying out soil and laboratory high-quality inspection;

observance of conditions of export and import of seeds.

Supervision of use in the economic purposes of seeds of grades of genetically engineered plants is carried out taking into account features, stipulated by the legislation.

4. Supervision in the field of seed farming is exercised by the Ministry of Agriculture and Food, public institution "Main state inspectorate for seed farming, quarantine and protection of plants", public institution "Brest regional state inspectorate for seed farming, quarantine and protection of plants", public institution "Vitebsk regional state inspectorate for seed farming, quarantine and protection of plants", public institution "Gomel regional state inspectorate for seed farming, quarantine and protection of plants", public institution "Grodno regional state inspectorate for seed farming, quarantine and protection of plants", public institution "Minsk regional state inspectorate for seed farming, quarantine and protection of plants", public institution "The Mogilev regional state inspectorate for seed farming, to quarantine and protection of plants" (further - the state inspectorates for seed farming, quarantine and protection of plants).

5. No. 961 is excluded according to the Resolution of Council of Ministers of the Republic of Belarus of 08.11.2013

6. Heads of the state inspectorates for seed farming, quarantine and protection of plants and their deputies exercising supervision in the field of seed farming are the chief state seed farming inspectors.

Heads of structural divisions of the state inspectorates for seed farming, quarantine and protection of plants, their deputies and specialists are the state seed farming inspectors.

7. When implementing supervising activities state (main state) the seed farming inspector has the rights established by legal acts.

8. State (main state)  the seed farming inspector performs the activities by conducting checks on compliance to requirements of the legislation performed by the checked subject of activities, and also actions (failure to act) of his officials and other workers.

9. The procedure for carrying out and registration of results of checks state (main state)  are performed by seed farming inspectors according to the requirements established by legal acts.

10. Responsibility for inadequate implementation of supervision in the field of seed farming is conferred on corresponding state (the main thing state) seed farming inspectors.

Regulations on procedure for carrying out the state testing of grades, procedure for inclusion of grades in the state register of grades, their exceptions of this register and procedure for its maintaining

1. This Provision determines procedure for carrying out the state testing of grades, procedure for their inclusion in the state register of grades, their exceptions of this register, and also procedure for its maintaining.

2. For the purposes of this provision the main terms and their determinations in the values established By the law the Republic of Belarus of May 2, 2013 "About seed farming" are used (The national legal Internet portal of the Republic of Belarus, 08.05. 2013, 2/2018), and also following terms and their determinations: 

the applicant - the author of grade (selector), his employer (in case of creation of office grade), their legal successor;

check variety - the grade of agricultural plant which is earlier included in the state register of grades which is distinguished from other grades of this plant included in the state register of grades, hozyaystvenno by valuable and biological properties.

3. The state register of grades represents single databank about grades of the agricultural plants which passed the state test of grades and allowed for production, realization and uses of their seeds in the territory of the Republic of Belarus which is created and conducted in printing and electronic type.
