About approval of Rules of interaction of structural divisions of the Ministry of Defence, General Staff and Armed Forces of the Republic of Kazakhstan when forming the state defense order

1. Approve the enclosed Rules of interaction of structural divisions of the Ministry of Defence, the General Staff and Armed Forces of the Republic of Kazakhstan when forming the state defense order and implementing public procurements for the benefit of the Ministry of Defence of the Republic of Kazakhstan.

2. "Body 20015" to provide the Ministries of Defence of the Republic of Kazakhstan in the procedure established by the legislation of the Republic of Kazakhstan to republican public institution:

1) the direction of this order in Reference control bank of regulatory legal acts of the Republic of Kazakhstan according to requirements of Item 10 of Rules of maintaining the State register of regulatory legal acts of the Republic of Kazakhstan, Reference control bank of the regulatory legal acts of the Republic of Kazakhstan approved by the order of the Government of the Republic of Kazakhstan of July 25, 2016 No. 439;

2) placement of this order on Internet resource of the Ministry of Defence of the Republic of Kazakhstan;

3) the direction of data in Legal department of the Ministry of Defence of the Republic of Kazakhstan on execution of the actions provided by subitems 1) and 2) of this Item within five calendar days from the date of its placement in Reference control bank of regulatory legal acts of the Republic of Kazakhstan.

3. Repeal the order of the Minister of Defence of the Republic of Kazakhstan of May 18, 2022 No. 312 "About approval of Rules of interaction of structural divisions of the Ministry of Defence, General Staff and Armed Forces of the Republic of Kazakhstan when forming the state defense order and implementing public procurements for the benefit of the Ministry of Defence of the Republic of Kazakhstan";

4. To impose control of execution of this order on the supervising deputy defense secretary of the Republic of Kazakhstan.

5. Bring this order to officials in the part concerning them.

6. This order becomes effective from the date of its signing.

Rules of interaction of structural divisions of the Ministry of Defence, the General Staff and Armed Forces of the Republic of Kazakhstan when forming the state defense order

Chapter 1. General provisions

1. These rules determine interaction of structural divisions of the Ministry of Defence, General Staff and Armed Forces of the Republic of Kazakhstan when forming the state defense order.

2. The basic concepts used in these rules:

1) the current financial year – the year preceding planned year;

2) the receiver – structural division of the Ministry of Defence, the General Staff, Armed Forces of the Republic of Kazakhstan, and also the republican public institution which are directly performing product acceptance of the defense order;

3) dovolstvuyushchy bodies – structural divisions of the Ministry of Defence, the General Staff of Armed Forces of the Republic of Kazakhstan, republican public institutions for the benefit of which it is made the ensuring with goods with military (products), goods (products) of dual purpose (application), military works and military services (further – products of the defense order) performing development of the tactical specification (the technical specification, tactical technical characteristic) (further – the specification) on products of the defense order, and also control over their acceptance;

3. Dovolstvuyushchy bodies and receivers are allowed to act in one person.

Chapter 2. Forming of the state defense order

Paragraph 1. Forming of the specification

4. Forming of the specification on products of the defense order is performed by dovolstvuyushchy bodies taking into account the requirement of Item 2 of article 20 of the Law of the Republic of Kazakhstan "About defense industry and the state defense order", and also provisions of Rules of forming, the placement and accomplishment of the state defense order approved by the order of the Government of the Republic of Kazakhstan of October 14, 2019 No. 759.
