About increase in efficiency of foreign economic activity

For the purpose of increase in efficiency of foreign economic activity:

1. Determine that:

1.1. The National Bank provides the information on the currency agreements registered according to subitem 2.3 of Item 2 of article 8 of the Law of the Republic of Belarus of July 22, 2003 No. 226-Z "About currency control and currency exchange control" which is bank secrecy of legal entities and individual entrepreneurs (further - data on agreements), to the following authorized bodies for ensuring accomplishment of the tasks and functions assigned to them according to the legislation:

to Agency of Foreign Economic Activity open joint stock company - concerning the agreements in foreign trade signed by the legal entities and individual entrepreneurs who are residents;

to state bodies and other state organizations - concerning the currency agreements signed by the organizations subordinated to these state bodies (organizations), which are their part, system and (or) economic societies, shares (share in authorized funds) of which are transferred to the control to these state bodies (organizations);

1.2. the information on agreements is provided by National Bank to the authorized bodies specified in paragraphs second and third subitem 1.1 of this Item based on the agreements signed between them and National Bank, on a grant basis by provision of remote access to the relevant data of the information resource for registration of currency agreements posted on the website of National Bank on the global computer Internet;

1.3. provision of data on agreements according to subitem 1.1 of this Item is not violation of bank secrecy. The authorized bodies specified in paragraphs second and third subitem 1.1 of this Item, which received data on agreements shall provide observance of requirements of the legislation on information, informatization and information security in case of their processing.

2. For the purposes of this Decree:

the terms "currency agreement" and "resident" are used in the values determined respectively in subitems 1.5 and 1.11 of Item 1 of article 1 of the Law of the Republic of Belarus "About currency control and currency exchange control";

the term "agreement in foreign trade" is used in the value determined in Item 2 of appendix 1 to the Presidential decree of the Republic of Belarus of March 27, 2008 No. 178 "About procedure for execution of agreements in foreign trade".

3. This Decree becomes effective since September 1, 2022.
