Millie decides Majlis of the Azerbaijan Republic:

1. Approve the Provision "About Rules of Compulsory National Insurance of the Workers Occupied with Delivery of Health Care to the Population, Carrying Out Scientific Research on Problems of Virology and Production of Virus Medicines, the Infection with Disease Caused by Human Immunodeficiency Virus in case of Accomplishment of Service Duties by Them and also from the Cases of Disability and Death Connected with It".

2. This Law becomes effective from the date of publication.

Regulations on rules of compulsory national insurance of the workers occupied with delivery of health care to the population, carrying out scientific research on problems of virology and production of virus medicines, the infection with disease caused by human immunodeficiency virus in case of accomplishment of service duties by them and also from the cases of their disability, limited opportunities of health connected with it up to 18 years and death

I. General provisions

1. This Provision aims to create additional guarantees on social protection of the workers occupied with delivery of health care to the population, carrying out scientific research on problems of virology and production of virus medicines from the disease caused by the human immunodeficiency virus (HIV) in case of accomplishment of service duties by them, and determines rules of compulsory personal insurance of these workers at the expense of public funds.

2. This type of insurance extends to physical persons of the following category:

a) the workers who are engaged in delivery of health care to the population;

b) the workers who are engaged in carrying out scientific research on virology problems;

c) the workers who are engaged in production of virus medicines;

3. Compulsory national personal insurance of the workers belonging to these categories is carried out by relevant organ of the executive authority at the expense of the government budget.

II. Insured events

The following is considered as insured events:

* infection of the worker of HIV in case of accomplishment of service duties by it;

* receipt of disability by the worker or limited opportunities of health up to 18 years owing to this disease;

* the death of the worker owing to this disease.

III. Insurance sum and insurance premium

1. The insurance sum is determined in the following sizes and as follows:

o infection of the worker of HIV in case of accomplishment of service duties by it - 1000 manat;

o in case of receipt by the worker of disability or limited opportunities of health up to 18 years owing to this disease - 2000 million manat;

o at deaths door the worker owing to this disease - 4000 million manat.

2. The insurance premium for each worker is established in the amount of 1,0 of % of the insurance sum intended for payment in case of the death of the insured worker owing to the disease caused by HIV.

3. The insurance premiums assessed on insurance sum annually no later than January 30 are paid by transfer to the account of relevant organ of the executive authority.

IV. Payment of insurance indemnity

1. The insurance indemnity is paid in the following sizes:

* in case of infection of the insured worker of HIV - 1000 manat;

* in case of disability or limited opportunities of health up to 18 years of the insured worker owing to this disease - 2000 million manat;

* at deaths door the insured worker owing to this disease - 4000 million manat.

2. The insurance indemnity intended for cases of infection of the worker of HIV in case of accomplishment of the service duties, his disability or with limited opportunities of health to 18 years and death is paid by executive relevant body of the power.

3. If the worker received insurance indemnity in connection with disease as a result of HIV infection, disability or limited opportunities of health up to 18 years and died directly of this disease, the insurance indemnity is paid to his heirs with deduction of the made earlier insurance payments.

V. Accounting of the workers who are put risk of HIV infection and the documents necessary for payment of insurance indemnity

1. Accounting of cases of infection of HIV of the workers occupied with delivery of health care to the population, carrying out scientific research on problems of virology and production of virus medicines in case of accomplishment of service duties, and also cases of their disability or limited opportunities of health by them up to 18 years and death with respect thereto, is performed by relevant organ of the executive authority in centralized procedure.

2. All documents required for payment of insurance indemnity to the HIV-positive workers who became to disabled people or with limited opportunities of health to 18 years owing to this disease and also are represented to heirs of persons who died owing to the disease caused by HIV to relevant organ of the executive authority.

3. For payment of insurance indemnity the following documents shall be submitted:

a) in connection with the death of the insured worker:

* statement of the heir;

* copy of the death certificate;

* certificate on the heredity right;

b) in connection with disease or disability or with limited opportunities of health to 18 years of the insured worker:

* statement of this worker;

* the medical reference in form No. 195 of disease or the certificate of disability or limited opportunities of health up to 18 years from relevant organ of the executive authority.

VI. Consideration of disputes

The disputes following from the national compulsory personal insurance of the workers occupied with delivery of health care to the workers who are put risk of HIV infection in case of accomplishment of service duties by them, carrying out scientific research concerning virology and production of virus medicines are solved according to the procedure, established by the legislation of the Azerbaijan Republic, including judicially.
