About approval of the Regulations on trade and economic bureaus (departments) as a part of diplomatic representations and consular establishments of the Republic of Moldova abroad

Based on part provisions (6) article 6 of the Law No. 761-XV of December 27, 2001 on diplomatic service (repeated publication: The official monitor of the Republic of Moldova, 2013, Art. No. 216-220, 645), with subsequent changes and amendments, articles 7 and 23 of the Law No. 1031-XIV of June 8, 2000 on state regulation of foreign trade activity (The official monitor of the Republic of Moldova, 2000, Art. No. 119-120, 838), with subsequent changes and amendments, and also for the purpose of aktivizirovaniye of activities of trade and economic bureaus (departments) as a part of diplomatic representations and consular establishments of the Republic of Moldova abroad, the Government DECIDES:

1. Approve Regulations on trade and economic bureaus (departments) as a part of diplomatic representations and consular establishments of the Republic of Moldova abroad according to appendix No. 1.

2. Recognize invalid some orders of the Government according to appendix No. 2.

Regulations on trade and economic bureaus (departments) as a part of diplomatic representations and consular establishments of the Republic of Moldova abroad

Chapter I General provisions

1. This Provision establishes the mission, the purposes and obligations of trade and economic bureaus (departments) as a part of diplomatic representations and consular establishments of the Republic of Moldova abroad (further - Trade and economic bureau (department), and also procedure for their organization and functioning.

2. The trade and economic bureau (department) represents and advances in adoptive state and the countries of accreditation in combination interests of the Republic of Moldova in the field of trade and economic activities.

3. The trade and economic bureau (department) is created by the order of the Government, on the common offering of the Ministry of Economics and Ministry of Foreign Affairs and European Integration approved with the Ministry of Finance as division of diplomatic missions or consular establishments of the Republic of Moldova abroad (further - diplomatic mission)

4. The trade and economic bureau (department) performs activities according to the Constitution of the Republic of Moldova, the Law No. 761-XV of December 27, 2001 on diplomatic service, other existing regulations, international treaties which part is the Republic of Moldova, this provision, and also mutually approved orders and orders of the Minister of Economic Affairs and Minister of Foreign Affairs and European Integration of the Republic of Moldova.

Chapter II Mission, purposes and obligations of trade and economic bureau (department)

Section 1 Mission and purposes of Trade and economic bureau (department)

5. The mission of Trade and economic bureau (department) is promotion of economic interests of the Republic of Moldova, protection of the rights of economic agents from the Republic of Moldova, assistance to development of trade and economic relations by investment attraction, promotions of trade exchange, in particular export of the Moldavian products and participation in implementation of bilateral and multilateral economic agreements in adoptive state and in the countries of accreditation in combination.

6. For realization of the mission the following purposes have Trade and economic bureau (department):

1) promotion of trade exchange, paying first-priority attention to export;

2) attraction of foreign investments and assistance in technology transfer in national economy;

3) development of cooperation with the international economic organizations which are in adoptive state and in the countries of accreditation in combination;

4) promotion of cooperation in the field of tourism.

Section 2 of the Obligation of Trade and economic bureau (department)

7. For realization of the purposes established by this Provision, the Trade and economic bureau (department) shall carry out the following obligations:

1) promotion of trade exchanges, first of all export, by means of:

a) strengthenings and deepenings of the legal base in the field of trade and economic relations with adoptive state and in the countries of accreditation in combination, and also development of offers on increase in their efficiency;

b) assistance in the organization of meetings of the mixed intergovernmental commissions on economic, trade, cultural, to sci-tech cooperation and other working groups, including formulation of offers for discussions at the meetings based on market research and tendencies in adoptive state and in the countries of accreditation in combination in cooperation with the industry public institutions participating in the commissions;

c) establishments of contacts with authorities and business communities in adoptive state and in the countries of accreditation in combination, in particular with potential business partners and investors, distributors of goods;

d) provisions of the specialized help to domestic economic agents, and also information on procedure for access to these markets, tariff and non-tariff barriers, local mechanisms of regulation, cultural distinctions, etc.;

e) identifications of the export markets and simplification of access of domestic production from sectors with the high export potential on the corresponding markets;

f) identifications and ensuring participation of the relevant foreign companies in actions for promotion of export from the Republic of Moldova for the purpose of establishment of partnership with the domestic companies;
