ORDER OF THE GOVERNMENT OF THE RUSSIAN FEDERATION

About introduction of temporary quantitative restriction on export of the regenerated papers and cardboard (waste paper and waste) out of limits of the territory of the Russian Federation to the states which are not members of the Eurasian Economic Union

According to the Federal Law "About Bases of State Regulation of Foreign Trade Activity" and the Agreement on the Eurasian Economic Union of May 29, 2014 (7) the Government of the Russian Federation decides appendix No.:

1. Establish from September 3 to December 3, 2022 inclusive quantitative restriction on export out of limits of the territory of the Russian Federation to the states which are not members of the Eurasian Economic Union, the regenerated papers and cardboard (waste paper and waste) (code of 4707 CN FEA EEU) (further - the regenerated paper and cardboard) who are significantly important for the domestic market of the Russian Federation when placing under customs procedure of export of 30 thousand tons (further - quota).

2. The quota does not extend to the regenerated paper and cardboard:

a) exported from the territory of the Russian Federation within the international transit carriages which are beginning and coming to an end outside the territory of the Russian Federation;

b) the territories of the Russian Federation moved between parts through the territories of foreign states;

c) the territories of the Russian Federation which are exported out of limits to the Donetsk People's Republic, the Luhansk People's Republic, the Republic of Abkhazia and the Republic South Ossetia;

d) exported about the territories of the Russian Federation issued according to the customs procedures allowing export regenerated paper and cardboard from the territory of the Russian Federation, till September 3, 2022, the papers and cardboard except for regenerated which customs declaring was performed with the features provided by Articles 115 and 116 of the Customs code of the Eurasian Economic Union or with the features established by the legislation of state members of the Eurasian Economic Union on customs regulation according to Item 8 of Article 104 of the Customs code of the Eurasian Economic Union;

e) exported from the territory of the Russian Federation by physical persons for private use.

3. Approve the enclosed Rules for apportionment between participants of foreign trade activity of quotas concerning regenerated paper and cardboard (waste paper and waste) which is taken out out of limits of the territory of the Russian Federation to the states which are not members of the Eurasian Economic Union.

4. To the Ministry of Industry and Trade of the Russian Federation:

a) provide distribution between participants of foreign trade activity admissible for export from the territory of the Russian Federation to the states which are not members of the Eurasian Economic Union, the amounts regenerated paper and cardboard, the stipulated in Item 1 this resolution till August 31, 2022;

b) provide placement of the order on distribution of quota on the official site on the Internet till August 31, 2022;

c) perform issue to participants of foreign trade activity of export licenses (further - the license) from the territory of the Russian Federation to the states which are not members of the Eurasian Economic Union, the regenerated papers and cardboard within the quotas distributed according to the Rules approved by this resolution.

5. To the Ministry of Economic Development of the Russian Federation in accordance with the established procedure:

a) notify the Eurasian economic commission on introduction of measure of non-tariff regulation in the form of temporary quantitative restriction on export from the territory of the Russian Federation to the states which are not members of the Eurasian Economic Union regenerated paper and cardboard;

b) submit for consideration of the Eurasian economic commission the offer on introduction of temporary quantitative restriction on export regenerated paper and cardboard from customs area of the Eurasian Economic Union.

6. To the Federal Customs Service:

a) provide control of the room of the regenerated papers and cardboard under customs procedure of export in the amount which is not exceeding quota amount according to the licenses granted by the Ministry of Industry and Trade of the Russian Federation;

b) allow departure of the regenerated papers and cardboard from the territory of the Russian Federation within effective period of the license granted by the Ministry of Industry and Trade of the Russian Federation.

7. The realization of this resolution is enabled by the corresponding federal executive bodies within the number of the workers and assignments of the federal budget provided by it on management and management in the field of the established functions established by the Government of the limiting Russian Federation.

8. This resolution becomes effective from the date of its official publication.

Rules for apportionment between participants of foreign trade activity of quotas concerning regenerated paper and cardboard (waste paper and waste) which is taken out out of limits of the territory of the Russian Federation to the states which are not members of the Eurasian Economic Union

1. These rules determine procedure for distribution between participants of foreign trade activity of quotas concerning the regenerated papers and cardboard (waste paper and waste) (code of 4707 CN FEA EEU) (further - the regenerated paper and cardboard) who are taken out out of limits of the territory of the Russian Federation to the states which are not members of the Eurasian Economic Union (further - quota).

2. Quotas are distributed by the Ministry of Industry and Trade of the Russian Federation between participants of foreign trade activity in proportion to amounts regenerated paper and cardboard, the exported each participant of foreign trade activity from January 1 to December 31, 2021 (further - base period) according to customs procedure of export, based on data of customs statistics.

3. Quotas are distributed by the Ministry of Industry and Trade of the Russian Federation taking into account the data containing in the Unified State Register of Legal Entities and the Unified State Register of Private Entrepreneurs, confirming lack of information about participants of foreign trade activity about the beginning of liquidation procedure, including insolvency proceeding according to the Federal Law "About Insolvency (Bankruptcy)".
