About approval of Rules of implementation of social resettlement of the victims of human trafficking

For the purpose of ensuring execution of Item 1.4 of the Presidential decree of the Azerbaijan Republic "About application of the Law of the Azerbaijan Republic "About fight against human trafficking" of August 4, 2005 the No. 272 Cabinet of Ministers of the Azerbaijan Republic decides:

1. Approve "Rules of implementation of social resettlement of the victims of human trafficking" (are applied).

2. This resolution becomes effective from the date of signing.

Rules of implementation of social resettlement of the victims of human trafficking

1. These rules are prepared based on the Presidential decree of the Azerbaijan Republic "About application of the Law of the Azerbaijan Republic "About fight against human trafficking" of August 4, 2005 No. 272 and determine the mechanism of social resettlement of the victims of human trafficking.

2. Social resettlement of the victims of human trafficking is performed for the purpose of their reintegration into society, return to normal conduct of life and provides rendering legal aid to the victims of human trafficking depending on age, sex and requirements, continuation of their study, taking measures for psychological, medical and employment rehabilitation, use of opportunities for providing these persons with work and living space.

3. Social resettlement of the victims of human trafficking is performed at the request of any person which provided itself as the victim of human trafficking, in the conditions of mutual cooperation of the special facilities (shelter for accommodation of the victims of human trafficking, the centers of the help to the victims of human trafficking) provided in the Law of the Azerbaijan Republic "About fight against human trafficking" with the Ministry of Internal Affairs of the Azerbaijan Republic, the Ministry of Health of the Azerbaijan Republic, the Ministry of Labour and Social Protection of the population of the Azerbaijan Republic, the Ministry of Education of the Azerbaijan Republic and other relevant organs provided in "The national plan of activities for fight against human trafficking".

4. For the purpose of implementation of social resettlement of the victims of human trafficking for each victim of human trafficking from the centers of the help the individual plan of social resettlement is constituted.

5. Creation of individual plans of social resettlement of the children who became the victims of human trafficking is performed taking into account provisions of the Law of the Azerbaijan Republic "About prevention of homelessness and offenses of minors".

6. The main directions of social resettlement of the victims of human trafficking are:

6.1. rendering legal aid to the victims of human trafficking for recovery of the rights;

6.2. rendering psychological assistance to the victims of human trafficking and to their family members for the purpose of elimination of the got psychological injury;

6.3. medical recovery of victims of trade lyudmiosushchestvleniye of the medical actions directed to recovery of the broken or lost functions, elimination of consequences of their diseases, the received injuries, complete or partial recovery of psychological, physiological and anatomic violations;

6.6. assistance, the human trafficking connected with continuation of education of the victims;

6.7. providing victims of human trafficking with living space.

7. The individual plan of social resettlement of the victims of human trafficking is performed as follows:

7.1.  No. 245 is excluded according to the Resolution of the Cabinet of Ministers of the Azerbaijan Republic of 25.06.2015

7.2. psychological assistance to the victims of human trafficking is performed by the Ministry of Health of the Azerbaijan Republic based on the direction of shelters and the centers, and also their help to the victims of human trafficking;

7.3. actions for medical rehabilitation are performed by the relevant medical institutions based on the directions of shelters and the centers of the help to the victims of human trafficking;

7.4. professional training, retraining and employment are performed in the procedure established by the legislation by bodies of employment service in the direction of the centers of the help to the victims of human trafficking;

7.5. education of the victims of human trafficking is performed in the procedure established by the legislation in educational institutions based on the direction of the centers of the help to the victims of human trafficking;

7.6. providing the victims of human trafficking with living space is performed based on representation of the centers of the help to the victims of human trafficking depending on their age, marital status and health by the Ministry of Labour and Social Protection of the population of the Azerbaijan Republic, the Ministry of Education of the Azerbaijan Republic, the Ministry of youth and sport of the Azerbaijan Republic, the Ministry of Health of the Azerbaijan Republic and local executive bodies.

8. Inclusion in the individual plan of social resettlement of the actions, in any form limiting rights of man and citizen or contradicting will of the victims of human trafficking is inadmissible.

9. Relevant international organizations and non-governmental organizations can be involved in implementation of actions for social resettlement of the victims of human trafficking.

10. Financing of social resettlement of the victims of human trafficking, including also the centers of the help to the victims of human trafficking, it is performed at the expense of the government budget of the Azerbaijan Republic and other sources, stipulated by the legislation the Azerbaijan Republic.
