1. This Law establishes the legal basis of regulation of the relations arising in the field of transactions with precious metals and gemstones including:
1) determines the basic concepts and conditions of carrying out transactions with precious metals and gemstones;
2) establishes the legal basis of state regulation and control of transactions with precious metals and gemstones;
3) determines bases of forming of the State fund of precious metals and gemstones of the Kyrgyz Republic.
2. Operation of this Law does not extend on:
1) the relations regulated by the legislation on subsoil;
2) the relations regulated by the bank law;
3) the relations connected with making by the physical persons who are not individual entrepreneurs, transactions with the jewelry and other products from precious metals which are in property of physical persons for private use.
1. The legislation in the field of transactions with precious metals and gemstones is based on the Constitution of the Kyrgyz Republic and consists of this Law and other regulatory legal acts and also which became effective in the procedure for international treaties established by the legislation which participant is the Kyrgyz Republic, governing the relations in the field of transactions with precious metals and gemstones.
2. Legal entities and individual entrepreneurs, the performing transactions (transactions) with precious metals and gemstones, shall observe the legislation of the Kyrgyz Republic in the field of counteraction to financing of terrorist activities and to legalization (washing) of the criminal income.
