About tourism

This Law according to Item 1 of part I of article 94 of the Constitution of the Azerbaijan Republic determines for the purpose of ensuring sustainable development of tourism in the Azerbaijan Republic bases of public administration in the field of tourism, mechanisms of regulation of the tourist industry, the rule of effective use of tourist resources and sources of financing of tourist industry.

Chapter 1. General provisions

Article 1. Basic concepts

1.1. The basic concepts used in this Law designate the following:

1.1.1. tourism - temporary trip of physical persons out of limits of the country (place) of permanent residence for the purpose of rest, acquaintance with cultural, historical and natural heritage, improving, recovery and other purposes provided that they are not engaged in paid activities in the country (place) of departure;

1.1.2. the tourist - the physical person which is temporarily staying in the country (place) of travel in the tourist purposes for a period of up to 90 days;

1.1.3. tourist resources - set of cultural and historical and natural heritage of the country (place) of travel, the infrastructure facilities and other objects capable to meet demand and the needs of tourists;

1.1.4. tourist product - set of the tourist resources systematized on certain content according to focus of interest of tourists;

1.1.5. safety of tourists - protection of life and health, property of tourists, and also prevention of distribution of personal data about them;

1.1.6. state body on tourism - the body (structure) determined by relevant organ of the executive authority, realizing state policy and regulation in the field of tourism;

1.1.7. tourist and recreational zones - the territories of tourist value with accurately established borders having special ecological and historical and cultural value allocated for the purpose of conservation, protection of historical and cultural heritage, the steady organization and sustainable development of tourism, encouragement of investment investments, and also promoting development of subjects of entrepreneurship;

1.1.8. The register of tourism - the electronic state information resource containing the database about tourist resources, tourist products and subjects of the tourist industry, statistical information on the tourist industry and tourist activities and results of monitoring of this information;

1.1.9. tourist services - services in placement, transport services (including leasing to tourists of vehicles), the services of the travel agent, tour operator, the tourist guide, service in the organization of public catering, entertaining, sports, cultural, business actions rendered to tourists on paid basis depending on the travel purpose and other services providing satisfaction of demand and needs of tourists;

1.1.10. the tourist industry - set of the legal entities and physical persons rendering tourist services and services of training in tourism, performing tourist and propaganda activities and also associations of the tourist industry;

1.1.11. tourist activities - activities of persons rendering tourist services;

1.1.12. tour operator - the legal entity performing preparation of tourist packet and its sale directly or through the travel agent;

1.1.13. travel agent - the physical person or legal entity performing sale of tourist services or the tourist packet prepared by tour operators or intermediary activities in this sphere;

1.1.14. tourist packet - the tourist product created by tour operator for certain term and on the basis of determined price, combining two and more tourist services;

1.1.15. tour - the trips in the tourist purposes organized according to the special program for a certain period of time;

1.1.16. tourist route - the route approved by state body on tourism which is combining tourist resources and tourist services having certain content on geographical spaces;

1.1.17. the tourist permit - the form of the strict reporting, the document confirming fee, entering tourist packet;

1.1.18. the tourist voucher - the document determining the tourist's right to the tourist services provided in tourist packet, and confirming rendering services;

1.1.19. the tourist guide - the physical person accompanying tourists within the tour on the basis of necessary knowledge of the country (place) of putevozhdeniye and its tourist resources and abilities and providing with their necessary information, making explanations about the visited tourist places;

1.1.20. means of placement - hotels (hotels), objects of hotel type rendering services in placement on paid basis and other objects intended for temporary residence;

1.1.21. hotel (hotel) - the means of placement with section of acceptance and registration, rooms with bathroom rendering of food service at least once a day and other additional services with a capacity of number of rooms at least 11 (eleven);

1.1.22. the one-day visitor - the physical person which is temporarily staying in the country (place) where it travels for the purpose of tourism.

Article 2. Forms and types of tourism

2.1. Depending on the direction of travel of tourists differentiate the following types of tourism:

2.1.1. internal tourism - travel of the physical persons living in the Azerbaijan Republic for the purpose of tourism within borders of the Azerbaijan Republic;

2.1.2. entrance tourism - travel in the tourist purposes in limits of borders of the Azerbaijan Republic of physical persons which residence is outside the Azerbaijan Republic;

2.1.3. outbound tourism - travel of the physical persons living in the Azerbaijan Republic in the tourist purposes out of limits of the Azerbaijan Republic.

2.2. Depending on the purpose of travel of tourists differentiate the following types of tourism:

2.2.1. cultural tourism - tourism for the purpose of acquaintance with material and non-material cultural heritage of the country (place) of travel;

2.2.2. ecological tourism (ecotourism) - the tourism including acquaintance with the nature, natural ecological system, biological and cultural diversity of the country (place) of travel, made on the basis of the principles of the minimum impact on the nature, protection of integrity of ecological system;

2.2.3. rural (communal) tourism - the tourism which is followed by participation of tourists in economic activity on agricultural objects (farms, arable sites, gardens, kitchen gardens, vineyards, etc. (agrotourism), rendering services in studying of rural conduct of life, natural, historical and cultural values of the local territory;

2.2.4. adventure tourism - the tourism which is followed by physical activity of tourists in the territories with special geographical characteristics, cultural exchange, interaction with the nature;

2.2.5. improving tourism - the tourism providing rendering treatment-and-prophylactic, diagnostic and other medical services to tourists in the country (place) of their travel (medical tourism), recreational services with use of natural medical resources and medical and improving places;

2.2.6. business tourism - the tourism performed for the purpose of participation in business actions (meetings, seminars, conferences, the congresses, exhibitions, etc.);
