About the cultural capital of Azerbaijan - the city of Shusha

Article 1. Shusha City National Park

1.1. In administrative borders of the cultural capital of Azerbaijan - the city of Shushi the Shusha City National Park is created.

1.2. The Shusha City National Park is under authority of the body (structure) determined by relevant organ of the executive authority.

Article 2. Territory of the Shusha City National Park

2.1. The territory of the Shusha City National Park is constituted by the parcels of land located in administrative borders of the city of Shushi.

2.2. In the territories adjacent to administrative borders of the city of Shushi and having with it natural and landscape, social, historical, cultural or economic link or important for protection, preserving or development of the Shusha City National Park, the body (structure) determined by relevant organ of the executive authority establishes borders of the conservation zone.

Article 3. The main directions of state policy in the city of Shusha

3.1. The main directions of state policy in the city of Shusha are:

3.1.1. ensuring recovery, reconstruction, studying, development and promoting of the city of Shushi;

3.1.2. ensuring preserving and immunity of space-planning structure of the historical and cultural monuments (further - monuments) located in the city of Shusha and also their recoveries, studying, purposeful use;

3.1.3. providing the organization and implementation of effective public administration in the city of Shusha, maintenance of use of innovative solutions in all spheres of life of the city;

3.1.4. creating favorable conditions for complete use of historical, cultural, tourist and recreational capacity of the city of Shushi;

3.1.5. ensuring revival and development of business activity in the territory of the city of Shushi;

3.1.6. taking measures to development and demonstration of scientific research, traditional crafts and other types of employment in the territory of the city of Shushi;

3.1.7. assistance of cultural activities and to cultural services in the city of Shusha;

3.1.8. ensuring development of the international cultural ties of the city of Shushi, and also strengthening of the authority of the city as one of pearls of world historical and cultural heritage.

Article 3-1. Use of the name of the city of Shusha

3-1.1. In connection with cases, the stipulated in Article 3-1.2 presents of the Law, the Shusha city national park has exclusive right on use of the name and the official name "Shusha".

3-1.2. Except as specified, established by the laws of the Azerbaijan Republic and the body (structure) determined relevant organ of the executive authority, use of the word "Shusha" (phrases with the word "Shusha") it is allowed only with the permission of the body (structure) determined by relevant organ of the executive authority in the following cases:

3-1.2.1. in names of legal entities, including subjects of media;

3-1.2.2. in names of awards and awards;

3-1.2.3. in names of actions of regional, republican or international level, including sports and other competitions, concerts, festivals, exhibitions, conferences, seminars;

3-1.2.4. for the commercial and advertizing purposes;

3-1.2.5. trademarks and geographical instructions.

Article 4. Legal regulation in the territory of the city of Shushi and its conservation zone

4.1. In the territory of the city of Shushi the legal regulation established by this Law and other regulatory legal acts of the Azerbaijan Republic is applied.

4.2. Spheres of legal regulation in the territory of the city of Shushi are:

4.2.1. restoration, protection, studying, use and promoting of monuments;

4.2.2. environmental protection;

4.2.3. construction, architectural and town-planning activities;

4.2.4. business activity;

4.2.5. tourist (recreational) activities, and also holding actions of local, republican and international level;

4.2.6. advertizing activities;

4.2.7. organization of transport, including regulation of entrance departure from the territory of the Shusha City National Park;

4.2.8. management of housing stock;

4.2.9. the organization of public administration in the territory of the Shusha City National Park and financing of the Shusha City National Park.

4.3. On spheres, the stipulated in Article 4.2 presents of the Law, in the city of Shusha can be established additional requirements in connection with regulation.

4.4. In the conservation zone of the city of Shushi the protection mode set by the body (structure) determined by relevant organ of the executive authority takes root.

Article 5. Restoration, protection, studying, use and promoting of monuments in the territory of the city of Shushi

5.1. The organization of the state protection and preserving the monuments located in the territory of the city of Shushi is provided by the body (structure) determined by relevant organ of the executive authority.

5.2. In the territory of the city of Shushi it is forbidden to change historical and architectural and art and esthetic shape of monuments, to take down monuments or to perform any activities which can pose for them threat.

5.3. The body (structure) determined by relevant organ of the executive authority can give written instructions to officials, physical persons and legal entities about restriction or suspension of the works posing threat to the monuments located in the territory of the city of Shushi. Content of written specifying, and also measure for threat elimination, procedure and duration of their realization are determined by the body (structure) determined by relevant organ of the executive authority.

5.4. In case of non-execution of written specifying the body (structure) determined by relevant organ of the executive authority provides implementation of measures, provided in specifying, and demands from persons which did not perform specifying, compensations of the incurred expenses, and also the caused damage.

5.5. Studying of monuments and carrying out archeological excavations in the territory of the city of Shushi are carried out with the consent of the body (structure) determined by relevant organ of the executive authority. When giving such consent the opinion of the body (structure) determined by relevant organ of the executive authority is considered.
