About monthly money payment to some categories of citizens

This Law provides creation of proper conditions for life support of some categories of citizens from among persons who have special merits before the Homeland which were directly involved in protection of sovereignty and territorial integrity of Ukraine (further - some categories of citizens from among persons who have special merits before the Homeland), and members of families of the died (died) citizens from among persons who have special merits before the Homeland, way of establishment of monthly money payment by it.

Section I. Basic provisions

Article 1. Main objectives of the Law

1. This Law is directed to creation of proper conditions for life support of some categories of citizens from among persons who have special merits before the Homeland, and members of families of the died (died) citizens from among persons who have special merits before the Homeland, way of establishment of monthly money payment by it.

2. The main objectives of this Law are:

1) proper celebration of some categories of citizens from among persons having special merits before the Homeland;

2) providing worthy living conditions of some categories of citizens from among persons having special merits before the Homeland;

3) the state support of members of families of the died (died) citizens from among persons having special merits before the Homeland.

Article 2. Law coverage

1. Operation of this Law extends to some categories of citizens from among persons who have special merits before the Homeland, and also on members of families of the died (died) citizens from among persons who have special merits before the Homeland.

2. Persons who were directly involved in protection of sovereignty and territorial integrity of Ukraine treat some categories of citizens from among persons who have special merits before the Homeland and:

1) which, since 2014, gives the rank the Hero of Ukraine with delivery of the award "Gold Star";

2) which, since 2014, are awarded by the Order of Bohdan Khmelnitsky of three degrees;

3) which, since 2014, "For Courage" of three degrees are awarded the order;

4) which, since 2014, princesses Olga of three degrees are awarded the order.

3. From among persons who have special merits before the Homeland to whom operation of this Law extends treat members of the family of the died (died) citizens:

1) parents and the wife (husband) if they reached the age granting the right to award of pension on age, established by part one of article 26 of the Law of Ukraine "About obligatory national pension insurance" (irrespective of duration of insurance years of service) or if they have pension entitlement, irrespective of age according to part three of article 114 of the Law of Ukraine "About obligatory national pension insurance", on early old-age pension, old-age pension on favorable terms or pension with reduction of retirement age according to the law or if they are persons with disability;

2) the children (including the children who were born before the expiration of 10 months from the date of the death of person who had special merits in front of Ukraine) who did not reach 18 years or is more senior than this age if they became persons with disability before achievement of 18 years.

The children studying in day form of education in organizations of general secondary education, and also organizations of professional (professional), professional prehigher or higher education (including during the period between completion of training in one of the specified educational institutions and receipt in other organization of education or during the period between completion of training in one educational qualification level and continuation of training in another provided that such period does not exceed four months), - before the termination of educational institutions, but no more than before achievement of 23 years by them, and orphan children - before achievement of 23 years by them irrespective of, they study or not.

4. Operation of this Law does not extend to persons, acts (actions or failure to act) of which were directly or indirectly directed, promoted and/or promote the state aggressor, its paramilitary groups and/or occupational administration of the state aggressor, violation of rights and freedoms of man and citizen, regulations of international humanitarian law and concerning which the conviction of court of Ukraine in connection with making of crime by them against bases of homeland security of Ukraine, making or assistance to making of act of terrorism, involvement in making of act of terrorism, public calls for making of act of terrorism, creation of terrorist group or the terrorist organization, terrorism financing, crime execution in the sphere of protection of the state secret, immunity of frontiers took legal effect, crimes against established procedure of execution of military service (war crime), crime against the world, safety of mankind and the international law and order.

Article 3. Monthly money payment to some categories of citizens from among persons who have special merits before the Homeland

1. Monthly money payment to some categories of citizens from among persons who have special merits before the Homeland (further - monthly money payment) is the monthly money payment guaranteed by the state which is appointed and paid to persons according to this Law.

The procedure for appointment and payment of monthly money payment and the list of the documents necessary for its appointment are established by the Cabinet of Ministers of Ukraine.

2. To persons who have the right to the monthly money payment provided by this Law and pensions according to the Law of Ukraine "About pensions for special merits in front of Ukraine" or to increase and/or pension supplements or monthly perpetual monetary pay, the government public assistance paid instead of pension according to the laws of Ukraine "About the status of veterans of war, guarantees of their social protection" "About the victims of Nazi prosecutions", payment for one of the bases at the choice of person is made.

Article 4. Amount of monthly money payment

1. Monthly money payment is paid from the date of the request for its appointment:

1) to persons specified in Item of 1 part two of article 2 of this Law - in the amount of three minimum wages established for January 1 of calendar year (at the rate on month);

2) to persons specified in Item 2 parts two of article 2 of this Law - in the amount of two minimum wages established for January 1 of calendar year (at the rate on month);

3) to persons specified in Items 3 and 4 of part two of article 2 of this Law - in the amount of the minimum wage established for January 1 of calendar year (at the rate on month);
