1. This Instruction is developed according to article 12 of the Law of the Republic of Belarus of December 25, 2005 "About quarantine and protection of plants" (The national register of legal acts of the Republic of Belarus, 2006, No. 6, 2/1174; National legal Internet portal of the Republic of Belarus, 21.07. 2016, 2/2396) is also established by procedure for destruction of quarantine products.
2. In this Instruction terms and determinations in the values established By the law the Republic of Belarus "About quarantine and protection of plants" are used.
3. Action of this Instruction extends on legal entities and physical person, including the individual entrepreneurs performing import, transit and the address with the loads containing quarantine products in the territory of the Republic of Belarus.
4. The quarantine products infected with quarantine objects and the quarantine products found in baggage and hand luggage of passengers, prohibited to import to the territory of the Republic of Belarus in the absence of possibility of performing its disinfecting are liable to destruction.
5. Destruction of quarantine products shall be made with observance of requirements of the legislation of the Republic of Belarus on environmental protection.
6. Destruction of the quarantine products infected with quarantine objects is performed at the expense of means of legal entities and individual entrepreneurs according to the procedure and on the conditions established by acts of the legislation of the Republic of Belarus.
Any expenses which arose in connection with transportation, storage, carrying out the cargo and other operations connected with destruction of quarantine products are not refunded to carrier, the owner or other persons.
7. Methods of destruction of quarantine products shall provide:
complete loss by the destroyed quarantine products of the initial, consumer properties then it cannot be used for the initial designated purpose;
exception of possibility of the subsequent recovery of initial, consumer properties of quarantine products;
compliance with law of the Republic of Belarus about environmental protection.
8. Destruction of quarantine products can be made by thermal, chemical or other impact (burning, destruction and so on with the subsequent burial).
9. Destruction of the quarantine products infected with quarantine objects is made no later than 10 working days from the date of receipt of the conclusion confirming availability of quarantine objects in quarantine products, and found in baggage and the hand luggage of passengers prohibited to import to the territory of the Republic of Belarus - within 5 days.
10. Destruction of quarantine products is made on the objects which are specially intended for this purpose having special permission (license) for the implementation of the activities connected with impact on the environment, issued by the Ministry of Natural Resources and Environmental Protection of the Republic of Belarus.
11. Transportation of quarantine products from the place of temporary storage to the place of their actual destruction and destruction of quarantine products are made in the presence of the state plant quarantine inspector.
12. About the actual destruction of the quarantine products infected with quarantine objects, the state plant quarantine inspector in whose zone of servicing the quarantine products infected with quarantine objects are found, and being present at such destruction the statement of destruction of quarantine products in form according to appendix to this Instruction is drawn up in triplicate (further - the act of destruction of quarantine products).
13. The act of destruction of the quarantine products infected with quarantine objects is signed by the state plant quarantine inspector, the owner (the representative of the owner) of load and the representative of person which made the actual destruction of quarantine products.
The first copy of the act of destruction remains in cases of the territorial organization of public institution "Main state inspectorate for seed farming, quarantine and protection of plants", the second copy - at the owner (the representative of the owner) of load.
14. The act on destruction of the quarantine products found in baggage and the hand luggage of passengers prohibited to import to the territory of the Republic of Belarus is constituted in duplicate and signed by the state plant quarantine inspector and the representative or the owner of baggage, hand luggage.
