About approval of the Regulations on procedure for financing of expenses of private institutions of education at the expense of means republican or local budgets

Based on part three of item 4 of article 129 of the Code of the Republic of Belarus about education the Council of Ministers of the Republic of Belarus DECIDES:

1. Approve Regulations on procedure for financing of expenses of private institutions of education at the expense of means republican or local budgets it (is applied).

2. This resolution becomes effective since September 1, 2022.

Regulations on procedure for financing of expenses of private institutions of education at the expense of means republican or local budgets

1. This Provision determines procedure for financing of expenses of the private institutions of education realizing educational programs of general secondary education which have the state accreditation on compliance to the declared type (further - private schools) and also the private institutions of education realizing educational programs of preschool education, vocational education at the level of preschool education, vocational education at the level of preschool education for persons with intellectual insufficiency (further - private kindergartens), at the expense of means republican and local budgets.

2. Financing of expenses can be performed:

private kindergartens - in the form of subsidies at the expense of the means provided in local budgets on preschool or general secondary education;

private schools, except for private schools based on which experimental activities in education are performed, - in the form of subsidies at the expense of the means provided in local budgets on general secondary education;

private schools based on which experimental activities in education are performed, - in the form of subsidies at the expense of the means provided in the republican budget to the Ministry of Education on general secondary education.

3. Financing terms of expenses of the private institutions of education specified in Item of 1 this provision (further, unless otherwise specified, - private institutions of education), are:

absence at private institutions of education at the time of application for financing of expenses according to item 4 of this provision of debt on obligatory payments in republican and (or) local budgets;

availability in private institutions of formation of places which are provided for acceptance (transfer) of children in the direction of management (department) of education *;

lack of empty seats in public institutions of education in the territory of the corresponding administrative-territorial (territorial) unit.

4. Till May 1 of the financial year preceding planned financial year in case of observance of the conditions specified in paragraphs second and third Item 3 this provision the application for financing of expenses is submitted:

private school, except for private schools based on which experimental activities in education are performed, private kindergarten - in management (department) of education ** in the territory of administrative-territorial (territorial) unit in the location of private institution of education;

private school based on which experimental activities in education are performed, - in the Ministry of Education.

The request for financing of expenses shall contain data on the number of places which are provided by private institutions of education for acceptance (transfer) of children in the direction of management (department) of education.

5. The decision on provision of financing of expenses of private institutions of education is made based on offers of the commission on consideration of requests for financing of expenses *** in case of observance of the conditions specified in Item 3 this provision and drawn up:

the order of the Minister of Education - when financing at the expense of means of the republican budget;

the decision of district, city executive committee or the body authorized by it - when financing at the expense of means of local budgets.

6. The planned annual amount of means republican or local budgets on financing of expenses of private institutions of education is determined proceeding from:

quantities of the expenses of places specified in the request for financing which are provided by private institutions of education for acceptance (transfer) of children in the direction of management (department) of education;

standard rates of expenses on training and education of one student and according to procedure for planning of expenses of local budgets on functioning of organizations of preschool and general secondary education;

the guaranteed and address ensuring implementation of measures for social protection of students regarding creation of conditions for the organization of their food based on cash expense rates on food and the number of days of visit by students of private institution of education in year.

7. Financing of expenses of private institutions of education is performed based on the agreement signed respectively between the Ministry of Education or management (department) of education and private institution of education for academic year (further - the agreement). In the agreement amounts of means are specified planned annual and planned monthly.

The planned monthly amount of funds for financing is calculated by the following formula:

12 months - number of months.

8. For money transfer republican or local budgets the private institution of education submits to territorial authority of the State Treasury the request containing calculation of the means which are subject to transfer to financing, and the agreement.
