1. Approve enclosed:

Regulations on the organization and implementation of licensed control of organization activity on use of nuclear materials and radioactive materials in case of work on use of atomic energy in the defense purposes, including development, production, testing, transportation (transportation), operation, storage, liquidation and utilization of nuclear weapon and military nuclear power plants, except for activities of military units and organizations of the Ministry of Defence of the Russian Federation in this area;

changes which are made to the order of the Government of the Russian Federation of July 31, 2017 No. 911 "About licensing of organization activity on use of nuclear materials and radioactive materials in case of work on use of atomic energy in the defense purposes, including development, production, testing, transportation (transportation), operation, storage, liquidation and utilization of nuclear weapon and military nuclear power plants, and implementation of licensed control of these activities" (The Russian Federation Code, 2017, No. 32, the Art. 5090).

2. State Atomic Energy Corporation "Rosatom" within 6 months to bring the regulatory legal acts into accord with Item 1 of this resolution.

3. This resolution becomes effective after 6 months from the date of its official publication, except for Item 2 of this resolution which is becoming effective from the date of official publication of this resolution.

1. This Provision establishes procedure for the organization and implementation of licensed control of organization activity on use of nuclear materials and radioactive materials in case of work on use of atomic energy in the defense purposes, including development, production, testing, transportation (transportation), operation, storage, liquidation and utilization of nuclear weapon and military nuclear power plants, except for activities of military units and organizations of the Ministry of Defence of the Russian Federation in this area (further respectively - the licensed type of activity, licensed control).

In this Provision of the concept "license applicant", "licensee", "license", "licensed requirements", "condition of action of the license" are used in the values established by Regulations on licensing of organization activity on use of nuclear materials and radioactive materials in case of work on use of atomic energy in the defense purposes including development, production, testing, transportation (transportation), operation, storage, liquidation and utilization of nuclear weapon and military nuclear power plants, the approved order of the Government of the Russian Federation of July 31, 2017 No. 911 "About licensing of organization activity on use of nuclear materials and radioactive materials in case of work on use of atomic energy in the defense purposes, including development, production, testing, transportation (transportation), operation, storage, liquidation and utilization of nuclear weapon and military nuclear power plants".

3. Provisions of the Federal Law "About Protection of the Rights of Legal Entities and Individual Entrepreneurs when Implementing the State Control (Supervision) and Municipal Control" taking into account requirements of the legislation of the Russian Federation about the state and protected by the law other secret, and also taking into account requirements of the legislation of the Russian Federation for information which free distribution is forbidden or limited are applied to the relations connected with the organization and implementation of licensed control till December 31, 2025 inclusive.

4. Licensed control is exercised by State Atomic Energy Corporation "Rosatom" (further - regulatory authority) for the purpose of:

a) checks of completeness and reliability of the data containing in the statement and the documents submitted by the license applicant for receipt of the license, including compliance of the license applicant to licensed requirements attached to it;

b) preventions, identification and suppression of violations by licensees of licensed requirements and conditions of action of licenses by means of:

holding actions for prevention of violations by the licensee of licensed requirements and conditions of action of licenses;

the organizations and conducting checks of licensees, acceptances of stipulated by the legislation measures of the Russian Federation for suppression and (or) elimination of effects of the revealed violations;

holding actions for licensed control without interaction with licensees;

systematic observation of execution of licensed requirements and conditions of action of licenses, the analysis and forecasting of condition of execution of licensed requirements and conditions of action of licenses when implementing by licensees of the licensed type of activity;

c) checks of observance of execution of the decisions made by results of control actions.
