About establishment of additional legal and social guarantees for citizens of the Republic of Poland who are in the territory of Ukraine

This Law is adopted in response to adoption of law of the Republic of Poland of March 12, 2022 "About the help to citizens of Ukraine in connection with armed conflict in the territory of this state" which is valid from February 24, 2022.

Taking into account the principle of reciprocity and as a token of gratitude the Polish Nation for solidarity and support of Ukraine in the conditions of the full-scale armed aggression of the Russian Federation this Law aims to liberalize conditions of stay of citizens of the Republic of Poland in the territory of Ukraine, establishes for them additional legal and social guarantees.

Article 1. Stay of citizens of the Republic of Poland in the territory of Ukraine

1. Citizens of the Republic of Poland, their spouses and children (irrespective of nationality) who in accordance with the established procedure drove to Ukraine from the territory of the Republic of Poland for temporary stay, and also their children who were born in the territory of Ukraine have the right to be in the territory of Ukraine on legal causes within 18 months from the date of entry into force of this Law.

Citizens of the Republic of Poland who according to this Law acquired the right on legal causes to be in Ukraine within 18 months have the right to extend the term of the legal stay in Ukraine in the presence of the relevant supporting documents (receipt in institutions of higher education, the translation for the next academic year, execution of an employment agreement (contract) and so forth).

2. Citizens of the Republic of Poland, their spouses and children who are in the territory of Ukraine on legal causes (further - citizens of the Republic of Poland) have all rights provided by the Law of Ukraine "About legal status of foreigners and stateless persons" taking into account guarantees of this Law.

3. The relations which are not settled by this Law are determined by the legislation of Ukraine governing the relations in the respective spheres and also international treaties of Ukraine.

Article 2. The rights of citizens of the Republic of Poland during their stay in the territory of Ukraine

1. Citizens of the Republic of Poland during their stay in the territory of Ukraine have the right on:

1) employment without the permission on application of work of foreigners and stateless persons;

2) state registration as taxpayers and receipt of registration number of accounting card of the taxpayer according to the legislation of Ukraine. The request for receipt of registration number of accounting card of the taxpayer on behalf of juveniles/minors of children is submitted by their parents and other legal representatives;

3) social protection which includes the right to providing in case of complete, partial or temporary disability, loss of the supporter, unemployment owing to circumstances according to the legislation and international treaties of Ukraine;

4) implementation of economic activity on the same conditions, as citizens of Ukraine;

5) education on the same conditions, as citizens of Ukraine, including at the expense of means of the government or local budget;

6) social payments (government assistance) according to the legislation of Ukraine. Such payments (benefits) are appointed after accomplishment of the conditions and criteria established by the legislation of Ukraine which regulates them since month in which the application for payment implementation, but not earlier than month in which the citizen of the Republic of Poland crossed frontier on entry into Ukraine is submitted. Social payments (government assistance) are performed it (is provided) after submission of the declaration on property condition and the income to those citizens of the Republic of Poland who got registration number of accounting card of the taxpayer according to the legislation of Ukraine;

7) receipt of the help from Social Security Fund of persons with disability on the same conditions, as citizens of Ukraine;

8) free medical care in the state and municipal healthcare institutions on the same conditions, as citizens of Ukraine.

Article 3. Residence permit

1. The basis for issue of the residence permit for citizens of the Republic of Poland who arrived to Ukraine for the purpose of employment or the conclusion gigabyte contract is the statement, the employment contract (contract) or gigabyte contract and employer obligation to notify the central executive body realizing state policy in the sphere of migration (immigration and emigration), including counteractions of illegal (illegal) migration, nationality, registration of physical persons, refugees and other categories of migrants determined by the legislation, on early termination or the termination of the employment contract (contract).

Except the specified documents, for obtaining citizens of the Republic of Poland give the residence permit:

1) passport document;

2) copies of pages of the passport document with personal data with the translation into Ukrainian certified in accordance with the established procedure;

3) the document confirming payment of the state fee and administrative collection for execution of the residence permit.

2. The residence permit is drawn up on effective period of the employment contract (contract), but no more than for three years.

3. Execution of the residence permit to citizens of the Republic of Poland who arrived to Ukraine for the purpose of employment is performed without receipt of the long-term visa.

4. Registration, issue, exchange, cancellation, recognition invalid, destruction of the residence permit is performed in the procedure established by the legislation of Ukraine.

Article 4. Education

1. Citizens of the Republic of Poland who get education in educational institutions of Ukraine have the rights and obligations provided for job seekers of education who are citizens of Ukraine, in particular, on receipt of grants, financial support, the state target support.

2. Citizens of the Republic of Poland who get education in organizations of professional prehigher, higher education have the right to soft long-term loans for receipt of the corresponding education or can be transferred to training at the expense of means of the government or local budget according to the procedure, determined for job seekers of education who are citizens of Ukraine.

Article 5. Rights of scientific, scientific and pedagogical workers

1. Citizens of the Republic of Poland who meet the requirements established by the legislation to persons who can hold positions of scientific, scientific and pedagogical workers have the right to employment in Ukraine to the corresponding positions on the same conditions, as citizens of Ukraine.

Article 6. The rights of specialists in health sector

1. The citizens of the Republic of Poland having qualification of the doctor, nurse (nurse), midwife (obstetrician) in the territory of member states of the European Union can perform professional activity in the territory of Ukraine within 18 months.
