About obligatory medical re-examination of drivers of motorized vehicles, self-propelled machines

Based on part ten of Article 23 and the paragraph of the seventh of article 27 of the Law of the Republic of Belarus of January 5, 2008 "About traffic" the Council of Ministers of the Republic of Belarus DECIDES: No. 313-Z

1. Approve the Instruction about procedure for the direction of drivers of motorized vehicles, self-propelled machines on obligatory medical re-examination it (is applied).

2. Determine that:

2.1. the notification of the driver of the motorized vehicle, the self-propelled machine (further, unless otherwise specified, – the driver) about decision making by the medical driver's commission about the availability of disease or contraindication interfering control of motorized vehicles, self-propelled machines (further – the decision), is performed by the medical driver's commission by results of medical re-examination by delivery to the driver of the conclusion personally under list in day of decision making;

2.2. in case of impossibility of confirmation by the driver for health reasons of receipt of the conclusion personally under list, and also refusal of its obtaining the conclusion is subject to the oral announcement to the driver in day of decision making;

2.3. in case of impossibility of the oral announcement of the conclusion or its delivery to the driver personally under list the conclusion within five calendar days from the date of decision making goes to the driver the registered mail with the notification;

2.4. the fact of delivery, the oral announcement (with indication of the reason of the oral announcement) or the directions to the driver of the conclusion is fixed in the act of the medical driver's commission.

3. The driver is considered notified on the made decision:

from the date of delivery or oral announcement to it conclusions;

from the date of sending to it the conclusions the registered mail with the notification – in case of impossibility of its delivery or the oral announcement.

4. This resolution becomes effective since September 22, 2022.

The instruction about procedure for the direction of drivers of motorized vehicles, self-propelled machines on obligatory medical re-examination

1. This Instruction determines procedure for the direction of drivers on obligatory medical re-examination, including notifications on such direction.

2. For the purposes of this Instruction the main terms and their determinations in the values established by the Law of the Republic of Belarus of June 18, 1993 No. 2435-XII "About health care" and the Law of the Republic of Belarus "About traffic are used".

3. The notification of the driver on the direction on obligatory medical re-examination is performed by the specialist doctor of the organization of health care or the employer by delivery of the direction on obligatory medical re-examination (further – the direction) in form according to appendix.

4. The direction is handed to the driver after identification of the bases for its issue personally under list, and in case of impossibility of confirmation by the driver for health reasons of receipt of the direction personally under list, and also refusal of its obtaining appears to the driver orally.

5. In case of refusal the driver from receipt of the direction, impossibility of its delivery personally under list or the oral announcement the direction goes to the driver within five calendar days from the date of identification of the bases for its issue by the registered mail with the notification.

6. In case of rendering medical care to the driver in the organization of health care in stationary conditions the direction is handed (appears) in day of the statement from the organization of health care.

7. The fact of delivery, the oral announcement (with indication of the reason of the oral announcement), sendings to the driver of the direction is fixed in the magazine of issue of the directions.

8. The direction is considered issued:

in day of its delivery or the oral announcement;

in day of its sending by the registered mail with the notification – in case of impossibility of its delivery or the oral announcement.

9. Information on delivery, the oral announcement, sending the direction by the organization of health care is introduced in medical documents of the driver.

10. The driver to whom the direction is issued voluntarily addresses to the organization of health care for passing of obligatory medical re-examination regarding the validity to control of motorized vehicles, self-propelled machines.

11. The information about the drivers directed to obligatory medical re-examination with indication of date of issue of the direction is represented:

the organizations of health care – to the Ministry of Internal Affairs and the Ministry of Agriculture and Food by means of remote access to centralized information system of health care based on agreements on information exchange or by the direction of lists of such drivers at least once a month in territorial subdivisions of the State automobile inspection of the Ministry of Internal Affairs and district, city (except Minsk), regional executive committees, the utility transport unitary enterprise "Minsktrans" (concerning persons having the car driver license on the right of control of wheel tractors, self-propelled machines);

employers for whom drivers work on hiring, – no later than ten calendar days from the date of issue of the direction in territorial subdivisions of the State automobile inspection of the Ministry of Internal Affairs, and in the presence at the worker of the car driver license on the right of control of the wheel tractor, self-propelled machine (certificate of the tractor operator-driver) – in territorial subdivisions of the State automobile inspection of the Ministry of Internal Affairs and district, city (except Minsk), regional executive committees, the utility transport unitary enterprise "Minsktrans" (concerning persons having the car driver license on the right of control of wheel tractors, self-propelled machines).

12. The organizations of health care represent to the Ministry of Internal Affairs and the Ministry of Agriculture and Food information on results of passing by drivers based on the direction of medical re-examination with indication of category of the motorized vehicle, the self-propelled machine by means of remote access to centralized information system of health care based on agreements on information exchange or send lists of such drivers at least once a month to territorial subdivisions of the State automobile inspection of the Ministry of Internal Affairs.
