According to Articles 17, of 21, of 22, 23 and 24 Federal Laws "About Accreditation in National Accreditation System" Government of the Russian Federation decide:

1. Approve enclosed:

Rules of implementation of accreditation in national accreditation system;

Rules of holding procedure of confirmation of competence of accredited person;

The rules of modification of the information about accredited person containing in the register of accredited persons and provided by Items 7 and 8 of part 1 of article 21 of the Federal law "About Accreditation in National Accreditation System";

Rules of consideration of the application of accredited person about cancellation of accreditation and acceptance by national authority on accreditation of the decision on accreditation cancellation;

changes which are made to the Rules of forming and maintaining the register of accredited persons, the register of experts in accreditation, the register of technical experts, the register of the expert organizations and provision of data from the specified registers approved by the order of the Government of the Russian Federation of July 1, 2014 No. 604 "About approval of Rules of forming and maintaining the register of accredited faces, the register of experts in accreditation, the register of technical experts, the register of the expert organizations and provision of data from the specified registers" (The Russian Federation Code, 2014, No. 28, Art. 4051; 2019, No. 13, Art. 1414).

Determine that till September 1, 2022 by provision by national authority on accreditation of the state services in accreditation, expansion of area of accreditation, confirmation of competence of accredited person for the purpose of receipt of the documents (information) necessary according to regulatory legal acts for provision of the specified state services, requests can go to state bodies, local government bodies and other organizations at which disposal necessary documents (information) are on paper the registered mail with the assurance of receipt or in electronic form.

3. Recognize invalid:

the order of the Government of the Russian Federation of June 5, 2014 No. 519 "About approval of aggregate terms of implementation of accreditation and the procedure of confirmation of competence of accredited face, including aggregate terms of carrying out documentary assessment of conformity of the applicant, accredited person to accreditation criterions and aggregate terms of carrying out exit assessment of conformity of the applicant, accredited person to accreditation criterions, and also terms of separate ministerial procedures when implementing accreditation and the procedure of confirmation of competence of accredited person" (The Russian Federation Code, 2014, No. 24, the Art. 3094);

Item of 5 changes which are made to acts of the Government of the Russian Federation, approved by the order of the Government of the Russian Federation of December 15, 2016 No. 1363 "About introduction of amendments to some acts of the Government of the Russian Federation" (The Russian Federation Code, 2016, No. 52, the Art. 7632);

Item of 3 changes which are made to acts of the Government of the Russian Federation, approved by the order of the Government of the Russian Federation of March 21, 2019 No. 300 "About introduction of amendments to some acts of the Government of the Russian Federation" (The Russian Federation Code, 2019, No. 13, the Art. 1414).

4. This resolution becomes effective since March 1, 2022, except for the subitem "b" of Item 5, of Item 7, of the paragraph of the third Item 27, of paragraphs two and third Item 33 of the Rules of implementation of accreditation in national accreditation system approved by this resolution, the subitem "b" of Item 8, of Item 10, of the paragraph of the fifth Item 26, of paragraphs two and third Item 32 and paragraph two of Item 38 of the Rules of holding procedure of confirmation of competence of accredited person approved by this resolution, which are becoming effective since September 1, 2022.

5. Rules of implementation of accreditation in national accreditation system, Rules of holding procedure of confirmation of competence of accredited person, the Rule of modification of the information about accredited person containing in the register of accredited persons and provided by Items 7 and 8 of part 1 of article 21 of the Federal law "About Accreditation in National Accreditation System", the Rule of consideration of the application of accredited person about cancellation of accreditation and acceptance by national authority on the accreditations of the decision on accreditation cancellation approved by this resolution are effective till March 1, 2028.

Rules of implementation of accreditation in national accreditation system

1. These rules establish procedure of accreditation of the legal entities and individual entrepreneurs applying for receipt of accreditation in national accreditation system (further - the applicant), including procedure for giving and consideration of the application about accreditation and the documents and data attached to it, the basis for return of the statement for accreditation without consideration, procedure for the termination of implementation of procedures of accreditation of the applicant based on its statement, procedure for evaluating compliance of the applicant to accreditation criterions, procedure for application of schemes of accreditation, procedure for forming and approval of the program of exit assessment of conformity of the applicant to accreditation criterions, including cases of carrying out exit assessment of conformity of the applicant to accreditation criterions remotely with use of means of remote interaction, including by means of audio-and video conferencings (further - remote assessment), and also cases and procedure for carrying out witness assessment.

Expansion of area of accreditation of the legal entities and individual entrepreneurs accredited in national accreditation system (further - accredited person), is performed according to the procedure, established by these rules for implementation of accreditation in national accreditation system.

2. For accreditation (expansion of area of accreditation) the applicant (accredited person) submits in national authority on accreditation the application for accreditation (expansion of area of accreditation) and documents and data, stipulated in Item 5 these rules attached to it.

3. The statement for accreditation (expansion of area of accreditation) is submitted the applicant (accredited person) in the form approved according to Item 3 of article 7 of the Federal law "About Accreditation in National Accreditation System" (further - the Federal Law on accreditation).

The application for accreditation (expansion of area of accreditation) is directed by means of the federal state information system "Single Portal of the State and Municipal Services (Functions)" or federal state information system in the field of accreditation (further - federal system in the field of accreditation) in the form of the electronic document and signed by the digital signature provided by part 1 of article 17 of the Federal Law on accreditation (further - the digital signature).

If the statement for accreditation (expansion of area of accreditation) and documents and data attached to it are signed by person authorized owing to the Federal Law or constituent documents to act on behalf of the applicant (accredited person) (the representative of the applicant, accredited person), copies of the documents confirming the power of the person which signed the specified application and documents and data attached to it are enclosed to the application for accreditation (expansion of area of accreditation).

4. In one statement for accreditation one area of accreditation according to one scheme of the accreditation accepted by national authority on accreditation according to Item 1.1 of article 4 of the Federal Law on accreditation taking into account international standards can be declared.

Based on one statement for accreditation in case of acceptance by national authority on accreditation by results of evaluating compliance of the applicant to accreditation criterions of the decision on accreditation to the applicant one unique number of record about accreditation in the register of accredited persons is assigned.

Expansion of area of accreditation of accredited person is performed according to the scheme of accreditation according to which accreditation was performed.

For receipt of accreditation in national accreditation system in 2 and more areas of accreditation according to 2 and more schemes of accreditation the applicant directs in accordance with the established procedure separate applications for accreditation with indication of in each statement of the respective area of accreditation and the scheme of accreditation.

5. The documents and data provided by the list approved according to Item 3 of article 7 of the Federal Law on accreditation are enclosed to the application for accreditation (expansion of area of accreditation) (further - the list of the documents and data enclosed to the application), including:

a) the declared area of accreditation;

b) the questionnaire of self-inspection of the applicant (accredited person) (further - the questionnaire of self-inspection);

c) copies of documents, and also the data confirming the applicant's compliance (accredited person) to accreditation criterions, provided by the list approved according to Item 1 of article 7 of the Federal Law on accreditation.

6. The declared area of accreditation is created with use of means of federal state information system in the field of accreditation (further - federal system in the field of accreditation) in the form of the electronic document and signed by the digital signature of the applicant (accredited person) (the representative of the applicant, accredited person) with observance of requirements of the legislation of the Russian Federation in the field of the digital signature.

The declared area of accreditation shall correspond to one scheme of the accreditation accepted by national authority on accreditation according to Item 1.1 of article 4 of the Federal Law on accreditation taking into account international standards.

7. The questionnaire of self-inspection is created with use of means of federal system in the field of accreditation in the form of the electronic document and signed by the digital signature of the applicant (accredited person) (the representative of the applicant, accredited person) with observance of requirements of the legislation of the Russian Federation in the field of the digital signature according to the form and technique established by national authority on accreditation.

8. In case of filing of application about accreditation (expansion of area of accreditation) the enclosed documents and data are represented by the applicant (accredited person) with use of means of federal system in the field of accreditation electronically, including in the form of electronic images (scan copy) of documents, and are signed by the digital signature of the applicant (accredited person) (the representative of the applicant, accredited person) with observance of requirements of the legislation of the Russian Federation in the field of the digital signature.

9. The documents and data constituted in foreign language shall be provided to national authority on accreditation with the translation into Russian certified in the procedure established by the legislation of the Russian Federation.

10. The national authority on accreditation has no right to demand from the applicant (accredited person) of specifying in the statement for accreditation (expansion of area of accreditation) of data, and also submission of the documents and data which are not provided by these rules, and also the application form and the list of the documents and data enclosed to the application for accreditation (expansion of area of accreditation).

11. The statement for accreditation (expansion of area of accreditation) and documents and data attached to it are registered national authority on accreditation no later than 1 working day from the date of their receipt in national authority on accreditation with use of means of federal system in the field of accreditation.

The national authority on accreditation electronically informs the applicant (accredited person) on registration date and details of the registered statement for accreditation (expansion of area of accreditation) (the registration number of the state service assigned in electronic document management system of national authority on accreditation).

12. The national authority on accreditation makes the decision on refusal in accreditation in case of receipt of the statement for accreditation (expansion of area of accreditation) and the enclosed documents and data on the bases provided by Items 1, of 5, 8 - 11 parts 4 of article 18 of the Federal Law on accreditation.

13. The national authority on accreditation makes the decision on refusal in accreditation (expansion of area of accreditation) at any stage of implementation of the procedure of accreditation (expansion of area of accreditation) in case of identification in the statement for accreditation (expansion of area of accreditation), documents and data attached to it, and also in other documents and data represented by the applicant (accredited person) during the procedure of accreditation (expansion of area of accreditation) for the purpose of confirmation of conformity to accreditation criterions, the doubtful or distorted information.

14. The statement for accreditation (expansion of area of accreditation) and the documents and data provided by the applicant (accredited person) to national authority on accreditation attached to it within 5 working days from the date of registration in electronic document management system of national authority on accreditation undergo testing:

a) with use of the means of federal system in the field of accreditation providing formatno-logical control including in respect of the data containing in the statement for accreditation (expansion of area of accreditation) and the documents and data attached to it, completeness (completeness), registration and form of representation;

b) by means of the direction of requests in authorized federal executive bodies and (or) the organizations with use of single system of interdepartmental electronic interaction for the purpose of confirmation:

the fact of entering of information about the applicant (accredited person) into the Unified State Register of Legal Entities (for legal entities) or the Unified State Register of Private Entrepreneurs (for individual entrepreneurs);

the fact of statement of the applicant (accredited person) on accounting in tax authority;

availability of the property right or other legal cause providing right of possession and uses of rooms, data on which are provided by the applicant (accredited person) in the documents enclosed to the application for accreditation (expansion of area of accreditation) and confirming the applicant's compliance (accredited person) to accreditation criterions;

compliance of the equipment and measuring instruments, data on which are provided by the applicant (accredited person) in the documents enclosed to the application for accreditation (expansion of area of accreditation) and confirming the applicant's compliance (accredited person) to accreditation criterions, requirements of the legislation of the Russian Federation in the field of ensuring unity of measurements (including regarding checking);

education availability at the applicant's workers (accredited person), data on which are provided by the applicant (accredited person) in the documents enclosed to the application for accreditation (expansion of area of accreditation) and confirming the applicant's compliance (accredited person) to accreditation criterions;

experience of work at the applicant's workers (accredited person), data on which is provided by the applicant (accredited person) in the documents enclosed to the application for accreditation (expansion of area of accreditation) and confirming the applicant's compliance (accredited person) to accreditation criterions.

15. In case of the technical reasons attracting impossibility of carrying out and (or) completion of conducting verification of the statement for accreditation (expansion of area of accreditation) and the documents and data attached to it according to Item 14 of these rules, including in connection with not receipt in national authority on accreditation of replies of authorized bodies and organizations at the scheduled time, the national authority on accreditation makes the decision on continuation of the procedure of accreditation of the applicant (expansion of area of accreditation of accredited person) according to these rules. In case of receipt in national authority on the accreditations from authorized federal executive bodies and (or) the organizations within replies to the requests provided by the subitem "b" of Item 14 of these rules, information specified in Item 18 of these rules, national authority on accreditation at any stage of the procedure of accreditation (expansion of area of accreditation) makes the decision on refusal in accreditation on the bases, stipulated in Item 1 and (or) 5 parts 4 of article 18 of the Federal Law on accreditation (decisions, stipulated in Item 19 these rules, - in case of holding procedure of expansion of area of accreditation).

16. By results of check, stipulated in Item 14 these rules, the statement for accreditation (expansion of area of accreditation) and documents and data attached to it return national authority on accreditation to the applicant (accredited person) without consideration in the following cases:
