About approval of Rules of identification of household cylinders and functioning of systems of accounting of household cylinders

According to subitem 18-6) of article 6 of the Law of the Republic of Kazakhstan "About gas and gas supply", PRIKAZYVAYU:

1. Approve the enclosed Rules of identification of household cylinders and functioning of systems of accounting of household cylinders.

2. To provide to department of gas and oil and gas chemistry of the Department of Energy of the Republic of Kazakhstan in the procedure established by the legislation of the Republic of Kazakhstan:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) placement of this order on Internet resource of the Department of Energy of the Republic of Kazakhstan;

3) within ten working days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan submission to Department of legal service of the Department of Energy of the Republic of Kazakhstan of data on execution of the actions provided by subitems 1) and 2) of this Item.

3. To impose control of execution of this order on the supervising vice-Minister of Energy of the Republic of Kazakhstan.

4. This order becomes effective after sixty calendar days after day of its first official publication.

Rules of identification of household cylinders and functioning of systems of accounting of household cylinders

Chapter 1. General provisions

1. These rules of identification of household cylinders and functioning of systems of accounting of household cylinders (further – Rules) are developed according to subitem 18-6) of Article 6 and Item 5 of article 29 of the Law of the Republic of Kazakhstan "About gas and gas supply" (further – the Law) and determine procedure for identification of household cylinders and functioning of systems of accounting of household cylinders.

2. The concepts used in these rules:

1) gas-filling Item – the engineering construction intended for storage, discharge and filling the liquefied oil gas in household cylinders;

2) the information system "Single State Management System Subsurface Use of the Republic of Kazakhstan" (further – EGSU) – the information system of authorized body in the field of hydrocarbons and production of uranium intended for collection, storage, the analysis and information processing in the field of subsurface use;

3) system of accounting of household cylinders – the complex of technical devices and the software intended for the automated collection, processing, storage and information transfer about turnover of household cylinders and amounts of the liquefied oil gas realized in household cylinders;

4) unique serial number of household cylinder – the unique number placed on household cylinder by the producer of this household cylinder;

5) unique code of household cylinder – the unique not repeated sequence of symbols generated by EGSU which is unambiguously identifying each filling the liquefied oil gas in household cylinder;

6) authorized body – the central executive body performing state regulation of production, transportation (transportation), storage and wholesale of gas, and also retail sale and consumption of the commodity and liquefied oil gas;

7) information system of authorized body – the integrated information system "Single State Management System Subsurface Use of the Republic of Kazakhstan" intended for collection, storage, the analysis and information processing in the field of subsurface use;

8) the digital signature (further – the EDS) – set of electronic digital symbols created by means of the EDS and confirming reliability of the electronic document, its accessory and invariance of content.

Chapter 2. Requirements to systems of accounting of household cylinders and procedure for confirmation of their compliance to such requirements, the bases and procedure for recognition of systems of accounting of household cylinders not conforming to the established requirements

3. Systems of accounting of household cylinders are created, develop and function according to Item 2 of article 38 of the Law of the Republic of Kazakhstan "About informatization" and on condition of accomplishment of the following requirements:

1) ensuring accounting of household cylinders by unique serial number of household cylinder;

2) are in commercial operation;

3) integration with information system of authorized body;

4) compliance to the Single requirements of information and communication technologies and ensuring information security approved by the order of the Government of the Republic of Kazakhstan of December 20, 2016 No. 832.

4. Availability of test reports with positive results of conformity testings to requirements of information security and integration availability with information system of authorized body is the basis for confirmation of their compliance to the established requirements.

Carrying out conformity testings to requirements of information security is performed according to the Rules of carrying out testing of objects of informatization of "the electronic government" and crucial objects of information and communication infrastructure on compliance to requirements of information security approved by authorized body in the field of ensuring information security according to the subitem 5) of article 7-1 of the Law of the Republic of Kazakhstan "About informatization".
