About the closed administrative-territorial education

This Law determines legal regime of the closed administrative-territorial education, measure of the state support of the citizens living and (or) working in the closed administrative-territorial formation, and feature of the organization of local self-government in the closed administrative-territorial education.

Article 1. General provisions

1. The closed administrative-territorial education is recognized the administrative-territorial education having local government bodies created according to the procedure, the stipulated in Article 2 presents of the Law, for the purpose of ensuring safe functioning which are in its territory of the organizations performing development, production, storage and utilization of weapons of mass destruction, conversion radioactive and constituting the increased danger of technogenic nature of other materials, military and other facilities (further - the organizations and (or) objects) for which for the purpose of ensuring defense of the country and safety of the state the specific mode of safe functioning and protection of the state secret including special conditions of accommodation of citizens is set.

2. All territory of the closed administrative-territorial education is the municipality territory with the status of the city district.

The territory and borders of the closed administrative-territorial education are determined proceeding from specific mode of safe functioning of the organizations and (or) objects, and also taking into account requirements of development of settlements.

In case of establishment and (or) change of borders of the closed administrative-territorial education and in case of its transformation requirements of the legislation of the Russian Federation about accounting of opinion of the population are not applied.

Borders of the closed administrative-territorial education for action of specific mode of safe functioning can not match borders of subjects of the Russian Federation.

The settlements located in the closed administrative-territorial education are part of the city district.

In case of establishment of harmful effects of the organizations and (or) objects located in the closed administrative-territorial education in the territory adjacent to borders of the closed administrative-territorial education, these territories according to the provision approved by the Government of the Russian Federation are given the status of zone of impact.

The list of zones of impact, their border, the land use mode, ecological actions are determined according to the provision approved by the Government of the Russian Federation.

3. The closed administrative-territorial education is under authority of federal bodies of the government on questions:

establishments of administrative subordination, borders of the specified education and the lands allocated to the organizations and (or) objects;

determinations of powers of public authorities of subjects of the Russian Federation concerning the specified education;

medical and sanitary providing in accordance with the legislation of the Russian Federation about protection of public health of the population of the closed administrative-territorial educations included in the list of the territories approved by the Government of the Russian Federation which population is provided with medical care in the medical institutions subordinated to the federal executive body performing functions on medical and sanitary providing the population of the separate territories, ensuring federal state sanitary and epidemiological surveillance on objects and the territories of the closed administrative-territorial educations;

issues of construction licenses on the parcels of land occupied by the organizations and (or) objects specified in Item 1 of this Article;

providing specific mode of the safe functioning of the organizations and (or) objects including special conditions of accommodation of citizens, protection of public order, and ensuring fire safety.

Decisions on the specified questions are made by the Government of the Russian Federation if other is not provided by the Federal Laws.
