The purpose of this Law is regulation of the relations in the field of the public civil service.
The legislation on the public civil service consists of this Law and other acts of the legislation.
The employment relationships of the government civil servants which are not settled by this Law are regulated by the Labor code of the Republic of Uzbekistan.
Operation of this Law extends to activities of the government civil servants on the positions entered in the State register of positions of the public civil service.
Operation of this Law does not extend to activities:
The president of the Republic of Uzbekistan, deputies of Legislative house and members of the Senate of the Oliy Majlis of the Republic of Uzbekistan, deputies of the Jokargi Kenes of the Republic of Karakalpakstan and other representative bodies of the government on places, the workers of offices of Legislative house and Senate of the Oliy Majlis of the Republic of Uzbekistan, members of Central Election Commission of the Republic of Uzbekistan, judges and workers of judicial system, board members of the Central bank of the Republic of Uzbekistan, government employees serving in bodies of prosecutor's office, internal affairs for defense, to emergency situations, National guard, the State Customs Service, Service of state security and Public service of safety of the President of the Republic of Uzbekistan, including the military personnel;
workers of technical, production and service personnel of state bodies.
Articles 24 and 43 of this Law do not extend to employees of diplomatic service.
Article 43 of this Law does not extend to employees of the Central bank of the Republic of Uzbekistan.
In this Law the following basic concepts are applied:
state body - organizationally the isolated structure having state powers of authority included in the List of state bodies and organizations into whom the public civil service is entered;
the public civil service - the type of public service representing professional paid activity of citizens of the Republic of Uzbekistan on ensuring implementation of powers of state bodies on positions of the public civil service;
professional competence of the government civil servant - set of knowledge, skills necessary for proper implementation of powers of state body;
position of the public civil service - the position entered in the State register of positions of the public civil service for implementation of powers of state body;
Rules of ethical behavior of the government civil servants - set of the regulations of ethics obligatory for observance by the government civil servants;
qualification requirements - the requirements to work experience and professional competence established by state body concerning the candidates applying for assignment of certain qualification rank of the public civil service and (or) occupation of certain position of the public civil service.
The basic principles of the public civil service are:
unity and stability of system of the public civil service;
legality;
justice;
service to the people;
responsibility of state bodies and officials to society and citizens;
priority of the rights, freedoms and legitimate interests of the person;
openness and transparency;
objectivity, professionalism and competence;
equal rights of citizens of the Republic of Uzbekistan on access to the public civil service;
legal and social protection of the government civil servants.
President of the Republic of Uzbekistan:
determines the priority directions of development and enhancement of the public civil service;
determines the organization-legal mechanisms connected with the organization of the public civil service;
appoints to position and dismisses the public civil service of faces carried to powers of the President of the Republic of Uzbekistan.
The president of the Republic of Uzbekistan can perform and other powers according to the law.
Cabinet of Ministers of the Republic of Uzbekistan:
coordinates activities of the ministries and other state bodies in the field of the public civil service;
appoints to position and dismisses the public civil service of faces carried to powers of the Cabinet of Ministers of the Republic of Uzbekistan;
provides development of financial and economic mechanisms of state programs and projects in the field of the public civil service within the powers and approves them.
The Cabinet of Ministers of the Republic of Uzbekistan can perform also other powers according to the legislation.
The agency of development of public service in case of the President of the Republic of Uzbekistan is specially authorized state body in the field of the public civil service (further - specially authorized state body).
Specially authorized state body:
realizes single state policy in the field of the public civil service;
