About approval of the Regulations on temporary requirements and procedure for evaluating compliance of separate wheel vehicles

For the purpose of implementation of the Decision of Council of the Eurasian economic commission of April 5, 2022 "About modification of the Decision of the Commission of the Customs union of December 9, 2011 No. 877" the Council of Ministers of the Republic of Belarus DECIDES: No. 45

1. Approve Regulations on temporary requirements and procedure for evaluating compliance of separate wheel vehicles it (is applied).

2. To the state committee on standardization to take measures for enforcement in the territory of the Republic of Belarus of the documents containing technical requirements, specified in appendix 1 to the Regulations on temporary requirements and procedure for evaluating compliance of separate wheel vehicles approved by this resolution.

3. This resolution becomes effective after its official publication and is effective till February 1, 2024.

Regulations on temporary requirements and procedure for evaluating compliance of separate wheel vehicles

Chapter 1. General provisions

1. Are established by this Provision:

the mandatory requirements applied concerning separate wheel vehicles and the chassis of the categories M, N and O made in the territory of the Republic of Belarus, procedure for application of these mandatory requirements and also assessment procedures of compliance of such vehicles in case of impossibility of evaluating compliance of wheel vehicles (chassis) according to requirements of the technical regulation of the Customs union "About safety of wheel vehicles" (TR CU 018/2011) approved by the Decision of the Commission of the Customs union of December 9, 2011 No. 877 (further – the technical regulation), during action of the mode of temporary restrictions of deliveries of the wheel vehicles completing for the Belarusian producers;

features of evaluating compliance of the single vehicles released in the territory of the Republic of Belarus without application of requirements for equipment of these vehicles devices (systems) of challenge of the emergency field services.

This Provision does not extend to the vehicles which are in operation in the Republic of Belarus and also to the vehicles imported by physical persons for private use.

2. For the purposes of this provision terms in the values established by the technical regulation and also the following terms are used:

accredited test laboratory – the test laboratory (center) accredited in the National accreditation system of the Republic of Belarus on the right of evaluating compliance of vehicles to requirements of the technical regulation and included in national part of the Unified register of conformity assessment bodies of the Eurasian Economic Union created according to the Agreement on the Eurasian Economic Union of May 29, 2014;

the single vehicle – the vehicle made in the Republic of Belarus in the conditions of serial production to which design in individual procedure changes before release into the stream of commerce were made, or made out of serial production in individual procedure of assembly set, or which is result of individual technical creativity, or released from among earlier delivered according to the state defensive order, or imported on the territory of the Republic of Belarus, not equipped with the device (system) of challenge of the emergency field services;

the applicant – the legal entity or the individual entrepreneur of the Republic of Belarus who are the manufacturer (his authorized representative) or performing import of the single vehicle, addressed with the request for evaluating compliance like the vehicle, type of the chassis or the single vehicle;

the conclusion – the conclusion about assessment like the vehicle (for the wheel vehicle), and (or) the conclusion about assessment like the chassis (for the chassis), and (or) the conclusion about assessment of the single vehicle (for the single vehicle) which are the documents on assessment of conformity certifying compliance of the released vehicles (chassis) to the technical requirements established by this Provision;

the manufacturer – the legal entity or the individual entrepreneur of the Republic of Belarus making wheel vehicles of categories M, N, O and the chassis, and also wheel vehicles with use of basic vehicles (chassis) which underwent assessment of conformity according to this Provision or requirements of the technical regulation;

certification body – the certification body accredited in the National accreditation system of the Republic of Belarus on the right of evaluating compliance of vehicles and components of vehicles to requirements of the technical regulation and included in national part of the Unified register of conformity assessment bodies of the Eurasian Economic Union created according to the Agreement on the Eurasian Economic Union of May 29, 2014;

the vehicle (chassis) – the wheel vehicle of categories M, N, O and the chassis which are object of technical regulation of the technical regulation, made by the manufacturer including with use of basic vehicles (chassis) which underwent assessment of conformity according to this Provision or requirements of the technical regulation.

3. Vehicles (chassis) manufactured in the territory of the Republic of Belarus are released and have the right to be in operation in the territory of the Republic of Belarus on condition of their compliance to the technical requirements in case of assessment of conformity of vehicles specified in the list according to appendix 1 (further if other is not provided, – technical requirements) that is confirmed by the conclusion about assessment like the vehicle in form according to appendix 2 and (or) the conclusion about assessment like the chassis in form according to appendix 3.

Single vehicles are released and have the right to be in operation in the territory of the Republic of Belarus on condition of their compliance:

to the requirements specified in paragraph four of subitem 17.2 of Item 17 of this provision that is confirmed by the conclusion about assessment of the single vehicle – for the single vehicles made in the territory of the Republic of Belarus;

to the requirements specified in paragraph five of subitem 17.2 of Item 17 of this provision that is confirmed by the conclusion about assessment of the single vehicle – for the single vehicles imported on the territory of the Republic of Belarus.

Vehicles (chassis) made in the Russian Federation according to its national requirements established for wheel vehicles based on the Decision of Council of the Eurasian economic commission of April 5, 2022 No. 45, are released, including can be used as basic vehicles (chassis) by manufacturers of vehicles of the Republic of Belarus, and also can be in operation in the territory of the Republic of Belarus.

The vehicles released in the Republic of Belarus according to requirements of this provision can not be equipped with devices (systems) of challenge of the emergency field services.

4. Concerning types of vehicles (chassis) which underwent assessment of conformity to requirements of the technical regulation evaluating compliance according to this Provision is not required.

5. The electronic passport of the vehicle (chassis) is drawn up based on the conclusions about assessment like the vehicle, type of the chassis and (or) the single vehicle which numbers are specified in electronic passports of the vehicle and (or) the chassis.

6. Execution of the conclusions about assessment like the vehicle, type of the chassis and (or) the single vehicle is performed on papers without use of special remedies from counterfeit or in electronic form with assignment of numbers according to structure of the document numbers certifying compliance to this Provision according to appendix 5.

Accounting of the issued conclusions is performed by the State committee on standardization.

7. As the documents confirming compliance like the vehicle (chassis) to technical requirements are recognized:

the messages on the official approval of type given by administrative authorities of member countries of the Agreement on adoption of uniform technical instructions for wheel vehicles, pieces of the equipment and parts which can be established and used on wheel vehicles, and about conditions of the mutual recognition of the official approvals issued on the basis of these instructions, concluded on March 20, 1958 in Geneva and (or) protocols to them;

the existing certificates of conformity issued within the technical regulation and (or) protocols to them;

test reports, carried out by accredited test laboratory or the manufacturer (carrying out testing on the equipment of the manufacturer, or in the presence of the representative of certification body, including with use of means of remote interaction, or with video fixing of process of carrying out testing with control of geoline item of the venue of testing is allowed, at the same time record of process of carrying out testing goes to certification body for the analysis and preparation of the test report);

the declarations of conformity registered according to provisions of the technical regulation (accepted according to the scheme 7d – only in case of assessment of conformity of small batches of vehicles (chassis), except categories Sq.m and M3.

8. As supporting documents concerning components of vehicles which assessment of conformity is carried out according to requirements of Rules of the United Nations (further – the UN) messages on the official approval of type and (or) certificates of conformity issued within requirements of the technical regulation are recognized.
