About export licensing of flax fiber

Based on article 47 of the Agreement on the Eurasian Economic Union of May 29, 2014 and subitem 1.5 of Item 1 of the Presidential decree of the Republic of Belarus of April 5, 2016 "About state regulation of foreign trade activity" the Council of Ministers of the Republic of Belarus DECIDES: No. 124

1. Determine that export from the Republic of Belarus of flax fiber * (code of 5301 single Commodity nomenclatures of foreign economic activity of the Eurasian Economic Union), occurring from the territory of the Republic of Belarus, when placing under customs procedure of export is performed under the one-time licenses granted by the Ministry of anti-monopoly regulation and trade in coordination with the Belarusian state concern on production and sales of goods of light industry (further – Bellegprom concern) according to the procedure, similar by the established Rules of issue of licenses and import permits and (or) commodity import provided by appendix to the Protocol on measures of non-tariff regulation concerning the third countries (appendix No. 7 to the Agreement on the Eurasian Economic Union of May 29, 2014), taking into account the features established by this resolution.

2. The legal entity, the individual entrepreneur interested in receipt of the export license of flax fiber (further – the applicant), represent to Bellegprom concern for review licensing:

the letter in any form with indication of the producer of flax fiber, the offered amount of export delivery of flax fiber, the country of its appointment, delivery conditions and payment;

the statement for licensing for export of flax fiber (in duplicate) according to the Instruction about execution of the statement on licensing for export and (or) import of separate types of goods and about execution of such license approved by the Decision of Board of the Eurasian economic commission of November 6, 2014 No. 199;

the copy of the contract in foreign trade (contract) for delivery of flax fiber for export out of limits of customs area of the Eurasian Economic Union containing price information on the delivered flax fiber including appendices to it, specifications (in case of their availability).

3. Copies of documents for review the licensing for export of flax fiber which arrived in Bellegprom concern in two-day time go it to the Ministry of Agriculture and Food (further – Ministry of Agriculture and Food Production) for review deliveries of flax fiber to export.

4. Ministry of Agriculture and Food Production performs approval of delivery of flax fiber for export or refuses approval within two working days from receipt date from Bellegprom concern of copies of the documents specified in Item 2 of this resolution by the direction of the corresponding letter.

5. The bases for refusal by Ministry of Agriculture and Food Production in approval of delivery of flax fiber for export are:

failure to carry out on the respective area of the delivery schedule of flax fiber on account of republican state needs since the beginning of calendar year (the accruing result);

absence at the self-produced applicant of flax stock (flax fiber).

6. The Bellegprom concern within five working days considers the documents which arrived from the applicant and in the presence of the letter of Ministry of Agriculture and Food Production specified in item 4 of this resolution makes the decision on approval of licensing for export of flax fiber or on refusal in approval of its issue.

7. The bases for refusal by Bellegprom concern in approval of licensing for export of flax fiber are:

failure to carry out by the applicant of the delivery schedule of flax fiber on account of republican state needs;

need of satisfaction (providing) of requirement in the domestic market of the Republic of Belarus for the flax fiber declared to export;

lack of approval of Ministry of Agriculture and Food Production;

the cases provided in article 25 of the Law of the Republic of Belarus of October 28, 2008 No. 433-Z "About bases of ministerial procedures".

8. Approval by Bellegprom concern of licensing for export of flax fiber is performed on a grant basis by putting down on the statement for licensing of the signature of person authorized on approval and impress of a seal of Bellegprom concern.

9. The approved application for licensing for export of flax fiber is directed by Bellegprom concern to the applicant by mail or handed personally under list.

10. Approve regulations of the ministerial procedure performed concerning subjects of managing according to the subitem * 25.15.33 "Approval of licensing for export of flax fiber (code of 5301 single Commodity nomenclatures of foreign economic activity of the Eurasian Economic Union) occurring from the territory of the Republic of Belarus" (is applied).

11. Add Item 25.15 of the single list of the ministerial procedures performed concerning subjects of the managing approved by the resolution of Council of Ministers of the Republic of Belarus of September 24, 2021 No. 548, subitem 25.15.33 of the following content:
