About interaction of customs authorities with participants of foreign economic activity

Based on item 4 of article 278 of the Law of the Republic of Belarus of January 10, 2014 No. 129-Z "About customs regulation in the Republic of Belarus", subitem 10.7 of Item 10 of the Regulations on the State Customs Committee of the Republic of Belarus approved by the Presidential decree of the Republic of Belarus of April 21, 2008 No. 228, the State Customs Committee of the Republic of Belarus DECIDES:

1. Determine that for the purpose of prevention and the prevention of violations in the field of customs regulation:

1.1. the customs authority which revealed signs of violations by the participants of foreign economic activity who are subject to customs control * (further - under control persons), the international treaties of the Republic of Belarus, other international treaties and acts constituting the right of the Eurasian Economic Union, and (or) the legislation on customs regulation regulating customs legal relationship (further - the customs legislation) using risk management system:

sends to the under control person information about the goods revealed after release signs of violations of the customs legislation by it, and also about methods of elimination of such violations on the last known customs authority to the location and (or) the residence of under control person;

holds with under control person consultations concerning assessment of violations of the customs legislation, and also application of the methods and measures directed to elimination of such violations;

* For the purposes of this resolution the participants of foreign economic activity who are subject to customs control are understood as the legal entities and individual entrepreneurs registered in the Republic of Belarus and performing activities in the field of customs affairs, determined using risk management system.

1.2. in time no later than one month from the date of the direction customs authority of information specified in the paragraph the second subitem 1.1 of this Item, under control person:

in case of consent with the signs of violations of the customs legislation revealed by customs authority - takes measures for elimination of such violations and informs on it customs authority;

in case of disagreement with the signs of violations of the customs legislation revealed by customs authority - informs on the disagreement customs authority with submission of supporting documents and (or) data;

1.3. if under control person in time, determined by paragraph one of subitem 1.2 of this Item, did not provide in customs authority information on consent or disagreement with the revealed signs of violations of the customs legislation and (or) rejection of measures for elimination of such violations, the customs authority takes measures for minimization of the revealed risks according to article 282 of the Law of the Republic of Belarus "About customs regulation in the Republic of Belarus".

2. This resolution becomes effective since July 25, 2022.
