About urgent measures for introduction of absolute state monopoly for production, storage and realization of ethyl alcohol

1. Enter in the territory of the Kyrgyz Republic since September 1, 2022 absolute state monopoly for production, import, storage and realization of ethyl alcohol.

2. Provide to the state company "Kara-Balta Spirtovy Plant" exclusive right on production, import of ethyl alcohol, realization of the ethyl alcohol made and imported to the Kyrgyz Republic.

To the business entities using ethyl alcohol within two weeks to submit to the state company "Kara-Balta Spirtovy Plant" for review current contracts on delivery and realization of ethyl alcohol.

2-1. Determine that the state company "Kara-Balta Spirtovy Plant" conducts procurement of the goods, works, services and consulting services connected with ensuring smooth operation on production of ethyl alcohol, alcoholic, pharmaceutical and perfumery and cosmetic products by carrying out market monitoring and the subsequent direct conclusion of agreements with suppliers without restriction of the amount of purchase.

3. Form the State agency on control of production and turnover of ethyl alcohol, alcoholic products under the Cabinet of Ministers of the Kyrgyz Republic (further - the State agency on control of production and turnover of ethyl alcohol, alcoholic products).

4. Determine that the main objective of the State agency on control of production and turnover of ethyl alcohol, alcoholic products is implementation of the state monopoly for production, import, storage and realization of ethyl alcohol, state regulation and control of production and turnover of ethyl alcohol, alcoholic and alcohol-containing products.

5. Assign the following functions to the State agency on control of production and turnover of ethyl alcohol, alcoholic products:

- development and realization of single state policy in the field of production, import, storage and turnover of ethyl alcohol, alcoholic and alcohol-containing products;

- licensing of production, turnover, import and export of ethyl alcohol, alcoholic and alcohol-containing products;

- quoting of import of ethyl alcohol and alcoholic products;

- organization and implementation of the state control of production, turnover of ethyl alcohol, alcoholic and alcohol-containing products, their quality and safety;

- the organization and implementation of the state accounting and the reporting in the field of production, turnover, import and export of ethyl alcohol, alcoholic and alcohol-containing products;

- control of compliance with law in the field of production, import, storage and the turnover of ethyl alcohol, alcoholic and alcohol-containing products and conditions provided by licensed requirements and technical regulations;

- carrying out in the procedure for checks of the business entities performing production and/or turnover of ethyl alcohol, alcoholic and alcohol-containing products established by the legislation of the Kyrgyz Republic;

- implementation of package of measures, providing consumer protection and domestic producers in the field of production, storage, movement and realization of ethyl alcohol, alcoholic and alcohol-containing products.

6. Bring in the Presidential decree of the Kyrgyz Republic "About the Cabinet of Ministers of the Kyrgyz Republic" of May 5, 2021 No. 114 the following change:

- add Item 5 with the paragraph the seventh the following content:

"-State agency on control of production and turnover of ethyl alcohol, alcoholic products".

7. To the Cabinet of Ministers of the Kyrgyz Republic in a month:

- approve Regulations on the State agency on control of production and turnover of ethyl alcohol, alcoholic products under the Cabinet of Ministers of the Kyrgyz Republic;

- submit for consideration of Jogorku Kenesh of the Kyrgyz Republic the bill of the Kyrgyz Republic "About the state monopoly for production, import, storage and realization of ethyl alcohol";

- in accordance with the established procedure to resolve the organizational, financial and other matters following from this Decree and also to bring the earlier made decisions into accord with this Decree.

8. To impose control of execution of this Decree on management of control of execution of decisions of the President and the Presidential Administration Cabinet of Ministers of the Kyrgyz Republic.

9. This Decree becomes effective from the date of official publication.
