About questions of acceptance of scrap and waste of the non-ferrous and ferrous metals alienated by public institutions and the companies

1. Determine the state company "Kyrgyzmetallprom" under the State agency on management of state-owned property under the Cabinet of Ministers of the Kyrgyz Republic (further - Kyrgyzmetallprom) the legal entity, the representative to perform acceptance of scrap and waste of the non-ferrous and ferrous metals alienated by public institutions and the companies.

2. Approve Regulations on procedure for alienation by public institutions and the companies of scrap and waste of non-ferrous and ferrous metals according to appendix.

3. Determine that Kyrgyzmetallprom has the right:

- realize in the domestic market scrap and waste of non-ferrous and ferrous metals to exclusively domestic overworking metallurgical enterprises registered in the territory of the Kyrgyz Republic;

- to independently perform industrial conversion of scrap and waste of non-ferrous and ferrous metals.

4. Ceased to be valid according to the Resolution of the Cabinet of Ministers of the Kyrgyz Republic of 27.10.2022 No. 589

5. Bring in the order of the Government of the Kyrgyz Republic "About approval of the Regulations on procedure for write-off of the fixed assets which are on balance of the state companies of the Kyrgyz Republic" of July 22, 2014 No. 407 the following change:

in Regulations on procedure for write-off of the fixed assets which are on the balance of the state companies of the Kyrgyz Republic approved by the above-stated resolution:

- state Item 41 in the following edition:

"41. The nodes withdrawn after dismantle and dismantling of property, details, materials and aggregates containing:

- precious materials and gemstones, are subject to realization in the buying up Items registered in the state authorized body according to the Law of the Kyrgyz Republic "About precious metals and gemstones";

- color and (or) black metals which are not used at the company for repair of machines, tools, the equipment are subject to realization of the organization authorized by the Cabinet of Ministers of the Kyrgyz Republic.".

6. Under the Cabinet of Ministers of the Kyrgyz Republic to provide to the state agency on management of state-owned property discovery of production base by Kyrgyzmetallprom on acceptance and conversion of scrap and waste of non-ferrous and ferrous metals.

7. Recommend to economic societies with the control state block of shares (share) in the authorized capital to be guided by this resolution in case of alienation of scrap and waste of non-ferrous and ferrous metals.

8. To impose control of execution of this resolution on management of control of execution of decisions of the President and the Presidential Administration Cabinet of Ministers of the Kyrgyz Republic.

9. This resolution becomes effective after ten days from the date of official publication.

Regulations on procedure for alienation by public institutions and companies of scrap and waste of non-ferrous and ferrous metals

1. This Provision is developed according to Item 12 of part 2 of article 13 of the constitutional Law of the Kyrgyz Republic "About the Cabinet of Ministers of the Kyrgyz Republic", Articles 230, of 231 Civil code of the Kyrgyz Republic and determines procedure for alienation by public institutions and companies of scrap and waste of non-ferrous and ferrous metals.

2. In this Provision the following terms and determinations are used:

public institutions and the companies - the state companies and organizations with the state pattern of ownership performing the rights of operational management and economic board concerning the state-owned property assigned to them;

scrap and waste of non-ferrous and ferrous metals:

- the products which became useless or lost the consumer properties from non-ferrous and (or) ferrous metals and their alloys including having the unrecoverable scrap arising in production process;

- withdrawn after dismantle and dismantling of property of part of products from non-ferrous and (or) ferrous metals and their alloys, unsuitable for direct use;

- waste in case of production of products from non-ferrous and (or) ferrous metals and alloys in the form of shaving, carving, cutting, droblenka, pimple;

the authorized organization - the legal entity authorized by the Cabinet of Ministers of the Kyrgyz Republic to perform acceptance of scrap and waste of the non-ferrous and ferrous metals alienated by public institutions and the companies.

3. Scrap and waste of non-ferrous and ferrous metals are subject to accounting and collection by public institutions and companies for further alienation by authorized organization.

The procedure for receipt of scrap and waste of non-ferrous and ferrous metals is determined by local regulating documents of public institutions and companies according to accounting policy.

4. Acceptance of scrap and waste of non-ferrous and ferrous metals is performed on stationary collection points for authorized organization with obligatory creation on each batch of scrap and waste of the acceptance report.

5. In the acceptance report shall be specified:

- name and details of public institution and company;

- data of the authorized person - the deliverer of scrap and waste;

- details of the route sheet or way bill;

- type and short description of scrap and waste;

- gross weight and net scrap and waste;

- purchase price.

6. Acceptance, sorting, storage, preprocessing of scrap and waste of non-ferrous and ferrous metals is performed by authorized organization with observance of the existing standards and legislations of the Kyrgyz Republic on technical regulation.
