Methodical instructions for determination of cadastral cost of again formed parcels of land and the existing parcels of land in cases of change of category of lands, type of the permitted use or refining of the area of the parcel of land

I. General provisions

1.1. Methodical instructions for determination of cadastral cost of again formed parcels of land and the existing parcels of land in cases of change of category of lands, type of the permitted use or refining of the area of the parcel of land (further - Methodical instructions) are developed according to Items 11 and 13 of Rules of carrying out the state cadastral assessment of the lands approved by the order of the Government of the Russian Federation of April 8, 2000 N316 (The Russian Federation Code, 2000, N 16, Art. 1709; 2006, N 16, Art. 1744).

1.2. Methodical instructions are applied to determination of cadastral cost of the parcels of land in cases:

- formations of the new parcel of land;

- changes of the area of the parcel of land;

- changes of type of the permitted use of the parcel of land;

- transfer of the parcel of land from one category in another or reference of the parcel of land to certain category of lands;

- inclusions in the State Immovable Property Cadastre of data on earlier considered parcel of land.

1.3. The cadastral cost of the parcels of land in the cases listed in Item 1.2 of these Methodical instructions is determined by the federal executive body authorized by the Government of the Russian Federation performing functions by the state cadastral assessment <*> or based on the decision of this body - state budgetary institutions subordinated to it.

1.4. Results of determination of cadastral cost of the parcels of land are reflected in the Act of determination of cadastral cost of the parcels of land.

1.5. The act of determination of cadastral cost of the parcels of land is drawn up for the parcels of land within one cadastral quarter.

In cases of simultaneous formation of several parcels of land or inclusions in the State Immovable Property Cadastre of data on earlier considered parcels of land within one cadastral quarter, and also in cases of simultaneous change of category of lands and (or) type of the permitted use, and (or) refining of the area of the parcels of land existing within one cadastral quarter one Act of determination of cadastral cost of the parcels of land is drawn up.

1.6. In case of education or inclusion in the State Immovable Property Cadastre of data on earlier considered parcel of land of single land use the act of determination of cadastral cost of the parcels of land (is attached) drawn up for each cadastral quarter in which the isolated or conditional parcels of land which are part of single land use, and also for conditional cadastral quarter in which single land use is located are located.

1.7. For the purposes of these Methodical instructions the parcels of land are subdivided into groups:

- as a part of lands of especially protected territories and objects:

the first group - the earth of especially protected natural territories (except for lands as a part of lands of medical and improving areas and resorts); earth of nature protection appointment; earth of residential green suburbs; earth of historical and cultural appointment; the parcels of land on which there are educational and tourist tracks, trasses; especially valuable lands.

the second group - the earth of recreational appointment (except for lands of residential green suburbs and the parcels of land on which there are educational and tourist tracks and trasses), the earth of medical and improving areas and resorts.

- as a part of lands of water fund:

the first group - the parcels of land occupied with the isolated water objects which are in circulation in accordance with the legislation of the Russian Federation;

the second group - the parcels of land occupied with the isolated water objects withdrawn from circulation or limited in turnover in accordance with the legislation of the Russian Federation, the constructions intended for protection against floods and destructions of coast of water storage basins, coast and bottom of beds of the rivers; constructions (dams) protecting storages of liquid waste of industrial and agricultural organizations; devices from washouts on channels, and also other constructions intended for prevention of harmful effects of waters and liquid waste as a part of lands of the water protection zones of water objects, and also lands allocated for establishment of strips of branch and zones of protection of water intakes, hydraulic engineering constructions and other water management constructions and objects;

the third group - the parcels of land as a part of lands of the water protection zones of water objects, and also lands allocated for establishment of strips of branch and zones of protection of water intakes, hydraulic engineering constructions and other water management constructions and objects occupied with subjects to water supply, objects of fish and hunting economy, hydraulic engineering constructions (except for the constructions intended for protection against floods and destructions of coast of water storage basins, coast and bottom of beds of the rivers; constructions (dams) protecting storages of liquid waste of industrial and agricultural organizations; devices from washouts on channels, and also other constructions intended for prevention of harmful effects of waters and liquid waste), water intaking, port and other water management installations and objects;
