1. Approve the enclosed Rules of provision of industrial grants.

2. To provide to committee of industrial development of the Ministry of the industry and infrastructure development of the Republic of Kazakhstan in the procedure established by the legislation:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) placement of this order on Internet resource of the Ministry of the industry and infrastructure development of the Republic of Kazakhstan.

3. To impose control of execution of this order on the supervising vice-minister of the industry and infrastructure development of the Republic of Kazakhstan.

4. This order becomes effective after ten calendar days after day of its first official publication.

Rules of provision of industrial grants

Chapter 1. General provisions

1. These rules of provision of industrial grants (further – Rules) are developed according to the subitem 25) of article 9 of the Law of the Republic of Kazakhstan "About industrial policy" (further – the Law) and determine procedure for provision of industrial grants.

2. Industrial grants are provided to the acting subjects of industrial and innovative activities of processing industry by joint financing with conditions of counter obligations for implementation of the industrial and innovative projects directed to creation of the competitive products included in the list of priority goods approved by the order of the acting minister of the industry and infrastructure development of the Republic of Kazakhstan of May 30, 2022 No. 306 "About approval of the List of priority goods" (it is registered in the Register of state registration of regulatory legal acts at No. 28264).

3. Provision of industrial grants is performed by authorized body in the field of the state stimulation of the industry with involvement of national institute of development in the field of industry development.

4. It is not provided industrial grants to subjects of industrial and innovative activities, fifty and more percent of shares (share in the authorized capital) which directly or indirectly belong to the state, national managing holding, national holding, the national company (except for social business corporation, and also the entrepreneurs founded within the agreement on public-private partnership).

5. Counter obligations are determined according to the rules by determination and application of counter obligations approved by the order of the acting minister of the industry and infrastructure development of the Republic of Kazakhstan of May 27, 2022 No. 298 "About approval of Rules by determination and application of counter obligations when rendering measures of the state stimulation of the industry" (it is registered in the Register of state registration of regulatory legal acts at No. 28281).

6. In these rules the following basic concepts are used:

1) information system – the organizational arranged set of the information and communication technologies, service personnel and technical documentation realizing certain technology actions by means of information exchange and intended for the solution of specific functional objectives;

2) the grantee – the subject of industrial and innovative activities who received industrial grant according to these rules;

3) engineering personnel – the physical persons having secondary professional or higher education (engineers and technicians, including the IT specialists) performing the organization and management of production process at the company;

4) upgrade of the company – complex of the actions directed to enhancement, production process automation, implementation of new technologies and capacities, personnel training;

5) the decision of the Commission - the decision made by members of the commission and which is drawn up by the protocol and containing data on vote results on question provision of industrial grant in case of equality of votes is deemed accepted the decision for which the commission chairman voted;

6) advanced technology – the technology having small practical application in the market and the high potential for further distribution;

7) the ofteyk-contract – the agreement on sale/purchase of goods and (or) services (raw materials production) which are going to make (to get) in the future, on in advance resolutive conditions at the cost, quantity (amount) and delivery dates, without the right of reduction of amount and the price of the contract;

8) industrial grant - the budgetary funds provided to subjects of industrial and innovative activities of processing industry for implementation of their industrial and innovative projects on a grant basis and which are irretrievable on condition of execution of counter obligations;

9) authorized body in the field of the state stimulation of the industry (further – authorized body) – the central executive body performing management in the field of the industry and also in limits, stipulated by the legislation the Republic of Kazakhstan, cross-industry coordination and participation in realization of the state stimulation of the industry;

10) subjects of industrial and innovative activities – physical and (or) legal entities, the particular partnerships realizing the industrial and innovative projects or performing activities for production of domestic goods of processing industry on internal and (or) the foreign markets;
