About provision in 2022 of the state guarantee according to obligations of joint-stock company "National joint stock company "Naftogaz of Ukraine"

Cabinet of Ministers of Ukraine decides:

1. According to item 4 of article 6 of the Law of Ukraine "About the Government budget of Ukraine for 2022" to agree with the offer of the Ministry of Economics on provision in 2022 of the state guarantee in ensuring accomplishment by joint-stock company "The national joint stock company "Naftogaz of Ukraine" of debt obligations according to the Credit agreement (The Renewable credit for emergency purchase of gas for Naftogaz) between joint-stock company "National joint stock company "Naftogaz of Ukraine" and the European Bank for Reconstruction and Development of June 14, 2022 (further - the Credit agreement) for the purpose of maintenance of its liquidity and stability of work at the rate to 300000 thousand euros.

2. Determine that:

the state guarantee is provided for ensuring accomplishment of the obligations specified in Item 1 of this resolution, including repayment of the main credit amount, the added percent and other obligations following from the Credit agreement;

the amount of payment for provision of the state guarantee is established at the 0,5 level of annual interest rate of the chosen and outstanding credit amount;

ensuring accomplishment of agreement obligations about debt repayment before the state for accomplishment of warranty obligations is not provided;

the state guarantee is provided for the term of accomplishment of obligations of joint-stock company "National joint stock company "Naftogaz of Ukraine", specified in Item 1 of this resolution;

operation of the resolution of the Cabinet of Ministers of Ukraine of February 23, 2011 No. 131 "About approval of the Regulations on risk management, connected with provision of the state guarantees, and distribution of these risks between the state, creditors and borrowers" (The Official Bulletin of Ukraine, 2011, No. 14, of the Art. 569) does not extend to provision of the state guarantee for ensuring accomplishment of the obligations specified in Item 1 of this resolution.

3. Authorize the Minister of Finance to sign documents on provision of the state guarantee for ensuring accomplishment by joint-stock company "National joint stock company "Naftogaz of Ukraine" of debt obligations according to the Credit agreement.

4. To the Ministry of Finance to sign with joint-stock company "The national joint stock company "Naftogaz of Ukraine" the agreement on debt repayment before the state for accomplishment of warranty obligations, having provided in it the right of the Ministry of Finance to contractual write-off of funds from accounts of joint-stock company "National joint stock company "Naftogaz of Ukraine" in organizations of banks as expense recovery of the government budget, the obligations connected with accomplishment on the state guarantee.
