RESOLUTION OF THE CABINET OF MINISTERS OF UKRAINE

of June 28, 2022 No. 740

Some questions of protection of the rights deported and internally displaced persons

Cabinet of Ministers of Ukraine decides:

1. Approve Regulations on the Representative for internally displaced persons which are applied.

2. Make changes which are applied to resolutions of the Cabinet of Ministers of Ukraine.

3. Recognize invalid:

the order of the Cabinet of Ministers of Ukraine of January 11, 2017 No. 8 "About approval of the Actions plan, some fundamentals of the state domestic policy directed to realization concerning certain districts of the Donetsk and Luhansk regions where public authorities temporarily do not perform the powers";

the order of the Cabinet of Ministers of Ukraine of July 19, 2017 No. 498 "About modification of Item 9 of the Actions plan, some fundamentals of the state domestic policy directed to realization concerning certain districts of the Donetsk and Luhansk regions where public authorities temporarily do not perform the powers".

Regulations on the Representative for internally displaced persons

1. The representative for internally displaced persons (further - the Representative) is official of Minreintegration whose main objective is participation in forming and realization of state policy concerning internally displaced persons and citizens of Ukraine who left the place of residence in the territory of Ukraine which is temporarily occupied by the Russian Federation (further - temporarily occupied territory) owing to armed conflict or for the purpose of avoidance of negative consequences of armed conflict and/or temporary occupation of part of the territory of Ukraine and went abroad, assistance of realization of their rights and freedoms and creation of conditions for voluntary return of such persons to the abandoned place of residence or integration at the new place of residence.

2. The representative in the activities is guided by the Constitution and the laws of Ukraine, acts of the President of Ukraine, the Cabinet of Ministers of Ukraine, Minreintegration, international treaties of Ukraine which consent to be bound is provided by the Verkhovna Rada of Ukraine, and this Provision.

3. The representative is deputy minister concerning reintegration of temporarily occupied territories.

4. The representative according to competence:

1) performs actions for assistance in the procedure established by the legislation to social security of internally displaced persons and citizens of Ukraine who left the place of residence in temporarily occupied territory owing to armed conflict or for the purpose of avoidance of negative consequences of armed conflict and/or temporary occupation of part of the territory of Ukraine and went abroad (further - faces which went abroad), social resettlement of persons imprisoned the Russian Federation, personal as a result of actions of paramilitary groups, and occupational administration and/or state bodies of the Russian Federation in temporarily occupied territory;

2) will be organized by interaction from Minsotspolitiki for assistance to ensuring provision to internally displaced persons of the humanitarian assistance;

3) will organize development of state programs on the questions concerning the internally displaced persons and persons who went abroad;

Prepares 4) for the Vice-Prime Minister of Ukraine - the Minister of reintegration of temporarily occupied territories of the offer on implementation of actions for providing the rights and freedoms of the internally displaced persons and persons who went abroad;

5) promotes informing internally displaced persons on employment opportunities in the respective settlements, and also promotes their employment;

6) participates in creation of conditions for voluntary return to the thrown place of residence or integration in the new place of residence of citizens of Ukraine, foreigners and stateless persons from temporarily occupied territory, internally displaced persons and persons who went abroad of their professional and social adaptation;

7) analyzes information on need of provision of housing and the solution of other questions of social protection of the internally displaced persons and persons which went abroad;

8) performs actions for assistance to education by the internally displaced persons and citizens of Ukraine living in temporarily occupied territory;

9) promotes implementation of the actions directed to accomplishment of the state and regional programs of social and economic and cultural development, protection of constitutional rights and legitimate interests of internally displaced persons;

10) interacts with state bodies, authorities of the Autonomous Republic of Crimea, local government bodies, other subjects of powers of authority, subjects of managing, public associations and charitable organizations, physical persons for the purpose of implementation of the powers;

11) obtains necessary information from public authorities, in particular, from public electronic registers;

12) provides preparation of recommendations to subjects of powers of authority concerning internally displaced persons;

13) participates in project development of regulatory legal acts concerning internally displaced persons;

14) promotes implementation of methodical providing central and local executive bodies, local government bodies, including the centers of provision of administrative services, concerning internally displaced persons;

15) carries out at the request of the Vice-Prime Minister of Ukraine - the Minister of reintegration of temporarily occupied territories other functions according to the law.

5. The representative submits at least once a month to the Cabinet of Ministers of Ukraine information on provision of internally displaced persons.
