About some questions of export of separate goods from the territory of the Republic of Kazakhstan

1. Enter quantitative restrictions (quotas) till September 30, 2022:

on export from the territory of the Republic of Kazakhstan to the third countries and to the countries of the Eurasian Economic Union of wheat and meslin (code of the commodity nomenclature of foreign economic activity of the Eurasian Economic Union 1001) in the amount of 550 000 tons;

on export from the territory of the Republic of Kazakhstan to the third countries of flour wheat and wheat and rye (code of the commodity nomenclature of foreign economic activity of the Eurasian Economic Union 110100) in the amount of 370 000 tons.

2. Approve the enclosed Rules for apportionment of quantitative restrictions (quotas).

3. And conversions of agricultural products of the Ministry of Agriculture of the Republic of Kazakhstan in the procedure established by the legislation to provide to department of the agrofood markets:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) placement of this order on Internet resource of the Ministry of Agriculture of the Republic of Kazakhstan after its official publication.

4. To impose control of execution of this order on the supervising vice-Minister of Agriculture of the Republic of Kazakhstan.

5. Operation of this order does not extend to commodity exportation from the territory of the Republic of Kazakhstan in state members of the Eurasian Economic Union, and also to the states which are not state members of the Eurasian Economic Union for the purpose of rendering the international humanitarian assistance to foreign states based on decisions of the Government of the Republic of Kazakhstan.

6. This order becomes effective after day of its first official publication and is effective till September 30, 2022.

Rules for apportionment of quantitative restrictions (quotas)

Chapter 1. General provisions

1. These rules of distribution of quantitative restrictions (quotas) (further – Rules) are developed according to Item 3 of article 18 of the Law of the Republic of Kazakhstan "On regulation of trading activity" and determine procedure for distribution of quantitative restrictions (quotas).

2. In these rules the following concepts are applied:

1) the operator on the grain market (further – the operator) – the national company in the field of agro-industrial complex participating in ensuring food security by means of implementation of stabilization function in the grain market and powers on management of reserve stock of grain;

2) participants of foreign trade activity (further – the applicant) – the physical persons performing foreign trade activity including registered as individual entrepreneurs according to the legislation of the Republic of Kazakhstan and the legal entities created according to the legislation of the Republic of Kazakhstan, and also the organization not being legal entities;

3) goods – wheat and meslin (code of the commodity nomenclature of foreign economic activity of the Eurasian Economic Union 1001) and flour wheat and wheat and rye (code of the commodity nomenclature of foreign economic activity of the Eurasian Economic Union 110100);

4) authorized body – Committee of the state inspection in agro-industrial complex of the Ministry of Agriculture of the Republic of Kazakhstan.

Chapter 2. Procedure for distribution of quantitative restrictions (quotas)

Distribution of amounts of quotas for commodity exportation from the territory of the Republic of Kazakhstan is performed in single automated control system for industries of agro-industrial complex "e-Agriculture" (further – IS EASU) automatically in case of issue of phytosanitary certificates according to the Rules on protection of the territory of the Republic of Kazakhstan from quarantine objects and alien types approved by the order of the Minister of Agriculture of the Republic of Kazakhstan of June 29, 2015 No. 15-08/590 (it is registered in the Register of state registration of regulatory legal acts No. 12032).

4. In case of overload (forming) of export consignments in places of secondary shipment in connection with change of method of transportation, the receiver, the address of the receiver, the place of departure, the quota amount issued in places of initial shipment remains invariable.

5. After enforcement of these rules in IS EASU the quantitative limit of amount of quota of types of goods is created.

6. The applicants who implemented to the operator of 10 (ten) percent from wheat amount declared to export from the territory of the Republic of Kazakhstan on fixed price by means of signing of the order on sale/purchase of the grain receipt in the state electronic register of holders of grain receipts on the cereal-receiving companies are allowed to distribution of quota for export of wheat.

The requirement provided in part one of this Item does not extend to applicants who realized to the operator 10 (ten) percent from wheat amount declared to export from the territory of the Republic of Kazakhstan on fixed price and did not perform export of wheat till June 15, 2022.

7. The operator on daily basis sends the letter to authorized body the list of the applicants who realized 10 (ten) percent from the amount of wheat declared to export from the territory of the Republic of Kazakhstan soft (Triticum aestivum L. 3 classes) on fixed price.

8. Distribution of amounts of quotas for commodity exportation from the territory of the Republic of Kazakhstan is performed in IS EASU on priority according to date and time of receipt of statements for receipt of the phytosanitary certificate for export of quarantine products out of limits of the Republic of Kazakhstan.
