1. This Federal Law determines legal status of Fund of pension and social insurance of the Russian Federation (further - the Fund), procedure for its creation, reorganization and liquidation, function and power of Fund, governing bodies of Fund and their competence, regulates the questions connected with ownership, use and the order of property of Fund and also establishes social guarantees to employees of Fund.
2. The fund is created by the Russian Federation for the purpose of implementation by the state of provision of pensions, mandatory pension insurance, compulsory social insurance on case of temporary disability and in connection with motherhood, compulsory social insurance from labor accidents and occupational diseases, social security, provision of measures of social protection (support) to separate categories of citizens, and also for the purpose of implementation of other state functions and powers assigned to Fund in accordance with the legislation of the Russian Federation.
1. The fund is created under the Government of the Russian Federation in form of business of the state non-budgetary fund which is type of public institution.
2. Functions and powers of the founder of Fund on behalf of the Russian Federation are performed by the Government of the Russian Federation.

12. The fund answers for the obligations all property belonging to it, except for property on which collection cannot be turned.
13. According to the obligations of Fund connected with content of Fund and ensuring its activities collection on the budget funds of Fund intended for obligation fulfillment of Fund cannot be turned:
1) on the mandatory pension insurance compulsory for social insurance on case of temporary disability and in connection with motherhood, to compulsory social insurance from labor accidents and occupational diseases;
2) on pension payment, benefits, to provision to separate categories of citizens of other measures of social protection (support);
3) on accomplishment of other functions and powers assigned to Fund by the legislation of the Russian Federation.
