Some questions of implementation of allowing and registration procedures in construction in the conditions of warlike situation

According to article 12-1 of the Law of Ukraine "About legal regime of warlike situation" the Cabinet of Ministers of Ukraine decides:

1. Determine that rendering services in questions of allowing and registration procedures in construction is performed taking into account the following features:

1) for action of warlike situation in Ukraine and within one year from the date of the termination or cancellation of warlike situation:

the construction of individual (farmstead) apartment houses, garden, country houses is not higher than two floors (without the mansard floor) up to 500 sq.m, economic buildings and constructions, garages, elements of improvement and gardening of the parcel of land according to the decision of the customer according to town-planning documentation at the local level, and in case of lack of the approved town-planning documentation at the local level - according to the purpose of the parcel of land and restrictions in use of lands determined by the Law of Ukraine "About protection of cultural heritage" can be performed by the customer without receipt of the construction passport of building of the parcel of land.

In that case the customer addresses the architect or the design engineer who has the appropriate qualification certificate, based on the agreement signed between them, the architect or the design engineer provides creation and/or loading in Single state electronic system in the field of construction (further - Electronic system) with imposing of the qualified digital signature of the scheme of intentions of the building of the parcel of land (location of buildings and constructions on the parcel of land, distances to borders of the next parcels of land and objects located on them, engineering networks and constructions, facades and plans of floors of objects with indication of overall dimensions, the list of systems of engineering support, including autonomous, planned to application, etc.) created with observance of requirements of the legislation, construction regulations and rules.

The term of performance of works, the size and payment procedure of works are determined in the agreement by agreement of the parties.

At the same time during submission of the notification on the beginning of accomplishment of construction works the customer specifies registration number of the scheme of intentions of building of the parcel of land in Electronic system;

in case of failure to provide by the relevant authorized body town planning and architecture of town-planning conditions and restrictions of building of the parcel of land or rejection of the decision on refusal in their provision within ten working days from the date of registration of a statement about their issue designing of construction object is performed without receipt of town-planning conditions and restrictions according to town-planning documentation at the local level and restrictions in use of the lands determined by the Law of Ukraine "About protection of cultural heritage";

development of the project documentation on construction of facilities with a conditional height not higher than 20 meters at distance at least 1 kilometer from side border of flight strip and 2 kilometers from end faces of flight strip is performed without approval of the operator of airfield, the Public air service or the Ministry of Defence.
