About approval of the Instruction about procedure for acceptance, registration and consideration of the applications and messages on the criminal offenses carried by the law to competence of Bureau of economic safety of Ukraine

According to the Criminal Procedure Code of Ukraine, the Law of Ukraine "About Bureau of economic safety of Ukraine", the Regulations on Bureau of economic safety of Ukraine approved by the resolution of the Cabinet of Ministers of Ukraine of October 06, 2021 No. 1068, for the purpose of the organization of acceptance, registration and consideration of the applications and messages on the criminal offenses carried by the law to competence of Bureau of economic safety of Ukraine I order:

1. Approve the Instruction about procedure for acceptance, registration and consideration of the applications and messages on the criminal offenses carried by the law to competence of Bureau of economic safety of Ukraine which is applied.

2. Coordination monitoring to management (to Spiridonov K. V.) together with legal department (Medvedeva Ya. S.) submit this order on state registration to the Ministry of Justice of Ukraine in the procedure established by the legislation.

3. This order becomes effective from the date of its official publication.

4. I reserve control of execution of this order.

The instruction about procedure for acceptance, registration and consideration of the applications and messages on the criminal offenses carried by the law to competence of Bureau of economic safety of Ukraine

I. General provisions

1. This Instruction determines procedure for acceptance, registration and consideration of the applications and messages on the criminal offenses carried by the law to competence of BEB.

2. Oral or written applications or messages in which circumstances which can demonstrate making of criminal offense, brought the applicant are stated are considered as the statement or the message on criminal offenses.

3. Statements or messages on criminal offenses, irrespective of the place and time of their making, and also completeness of the reported data and form of representation, surely are accepted in BEB.

The refusal in adoption of statements and messages on criminal offenses is forbidden.

Statements and messages on criminal offenses can be submitted to BEB on personal acceptance, through special box for correspondence, by mail, or other types of communication.

4. The organization of work in BEB on registration of statements and messages on criminal offenses is assigned to the report clerk of structural division of BEB, performing pretrial investigation and inquiry.

II. Procedure for acceptance, registration and processing of statements for criminal offenses

1. Statements or messages on criminal offenses are accepted by authorized persons in working hours, according to the approved working hours of BEB, on the location of central office (territorial administration) of BEB.

2. Statements or messages on criminal offenses in BEB are authorized to accept (further - authorized persons):

1) report clerks of structural division of BEB performing pretrial investigation and inquiry - persons who according to requirements of the Standard instruction for documentation of management information electronically and the organizations of the work with electronic documents in clerical work, electronic interdepartmental exchange approved by the resolution of the Cabinet of Ministers of Ukraine of January 17, 2018 No. 55, on a centralized basis perform registration of statements and messages on the criminal offenses in BEB electronic document management system (further - EDMS) arriving in BEB through special box for correspondence, by mail or other types of communication;

2) heads (deputy managers), the senior detectives, detectives of divisions of detectives of BEB (further - the detective) in case of the personal address of the applicant.

3. The statement or the message on criminal offense shall contain such data:

1) surname, name, middle name (in the presence) applicant, residential address, signature. In case of submission of the statement or the message by the worker (office or the official) the companies, organizations or the organizations are specified also position, the name and the address of the location of the company, organization, organization, contact phone number;
