About the rights of disabled people and their social integration

This Law establishes the rights of disabled people, including handicapped children (further if other is not determined, – disabled people), determines guarantees of implementation of their rights, ensuring equality and nondiscrimination on the basis of disability and is directed to improvement of quality of life of disabled people, creation and providing proper conditions for complete and equal participation of disabled people in life of society, and also to disability prevention.

Chapter 1. General provisions

Article 1. The main terms used in this Law and their determinations

For the purposes of this Law the following main terms and their determinations are used:

the disabled person's abilitation – package of measures, directed to forming, development and maintenance of the functions of bodies or systems of organism, capabilities, skills which were absent earlier at the disabled person to household, public, professional and other work;

assistivny devices and technologies – devices, the equipment, the software, the special technologies, other supportive applications provided for complete or partial overcoming, replacement (compensation) of restrictions of activity, technical means of social resettlement of disabled people;

audiodescription – technology of the verbal description of visual content of objects, actions, the spaces unavailable to disabled people with sight violations;

discrimination on the basis of disability – any distinctions, exceptions or restrictions on the disability reason, the purpose or of which derogation or denial of recognition, implementation on an equal basis with other people of all civil, political, economic, social, cultural and other laws and freedoms guaranteed in the Republic of Belarus are result;

the available circle – the condition and quality of the habitat, including vehicles, the information and communication circle allowing disabled people to perform the rights and to participate in life of society on an equal basis with other people;

sign language – the sign system which is naturally created by people with hearing disorder and correlating conceptual content to spatial and visual reproduction;

the disabled person – the person with steady physical, mental, intellectual or touch violations which in case of interaction can interfere it with various barriers with complete and effective participation in life of society on an equal basis with other people;

disability – result of interaction between the people having violations of health and relational, environmental barriers which interferes them with complete and effective participation in life of society on an equal basis with other people;

the individual program of rehabilitation, the disabled person's abilitation, the individual program of rehabilitation, the handicapped child's abilitation (further – the individual program of rehabilitation, the disabled person's abilitation) – the document determining complex of actions for rehabilitation, the disabled person's abilitation, terms of their carrying out and also contractors;

public associations of disabled people – voluntary associations of citizens which more than 50 percent of members are constituted by disabled people (their legal representatives) and which main authorized objectives are implementation of measures for providing equal opportunities of participation of disabled people in all spheres of activity of society, observance and protection of their rights and legitimate interests on an equal basis with other people;

activity restriction – complete or partial loss by the person of capability or opportunity to perform self-service, to independently move, be guided, communicate, to control the behavior, to study, be engaged in labor activity, and the child aged up to 18 years – to perform the leading age activities;

reasonable adaptation – the necessary and suitable modifications and amendments introduced when it is necessary in specific case, for the purpose of ensuring realization or implementation by disabled people of the rights and freedoms on an equal basis with other people;

rehabilitation of the disabled person – package of measures, directed to complete or partial recovery broken and (or) compensation of the lost functions of bodies or systems of organism, capabilities, skills to household, public, professional and other work and their maintenance;

social integration of disabled people – package of measures, the equal opportunities accepted in the fields of social protection, employment of the population, education, physical culture and sport, health care, the housing relations, information and informatization, cultures both other areas and aimed at providing for implementation by disabled people of the rights and their participation in life of society on an equal basis with other people;

social support of disabled people – system of the measures providing social guarantees to disabled people in payment type of pensions, benefits, provisions of the government address public assistance, the state social privileges, rights and guarantees established by the legislation;

specialized workplace – the workplace for work of the disabled person equipped if necessary with the capital and service equipment on which the labor obligations allow the disabled person to satisfy working conditions and do not contradict the individual program of rehabilitation, the disabled person's abilitation;

universal design – the design of objects, situations, programs and services designed to make them in the greatest possible degree suitable for use for all people without the need for adaptation or special design, which is not excluding use of assistivny devices and technologies;

clear language – the form of display (reproduction) of written, oral and other information available to the people experiencing difficulties in her perception and understanding, providing transformation of such information for the purpose of exception of the difficult and borrowed terms and concepts, simplifications of structure of the statement, specification, reducing the text, arrangement of words in certain sequence.

Other terms are determined in individual clauses of this Law.

Article 2. Legal regulation of the relations connected with the rights of disabled people and their social integration

The relations connected with the rights of disabled people and their social integration are regulated by the legislation on the rights of disabled people and their social integration, and also the international treaties of the Republic of Belarus and other international legal acts containing obligations of the Republic of Belarus.

The legislation on the rights of disabled people and their social integration is based on the Constitution of the Republic of Belarus and consists of this Law and other acts of the legislation.

If the international treaty of the Republic of Belarus establishes other rules, than those which contain in this Law then are applied rules of the international treaty.

Article 3. Coverage of this Law

Operation of this Law extends to the citizens of the Republic of Belarus, foreign citizens and persons without citizenship who are constantly living in the Republic of Belarus (further – citizens), being disabled people irrespective of group and the reason of disability, extent of loss of health.

Article 4. International cooperation in the field of providing the rights of disabled people and their social integration

The Republic of Belarus performs international cooperation in the field of providing the rights of disabled people and their social integration with foreign states, the international organizations and interstate educations according to the procedure, established by the legislation and international treaties of the Republic of Belarus.

Article 5. State policy in the field of providing the rights of disabled people and their social integration

State policy in the field of providing the rights of disabled people and their social integration is expressed in creation of legal, economic and social conditions for ensuring realization and protection of the rights and freedoms of disabled people, their integration into society.

The basic principles of state policy in the field of providing the rights of disabled people and their social integration are:

equality and observance of rights and freedoms of man and citizen;

providing equal opportunities of realization by disabled people of the rights and their participation in life of society on an equal basis with other people;

prohibition of discrimination on the basis of disability;

inklyuziya in education;

security of rehabilitation, abilitation of disabled people;

security of social support of disabled people;

interdepartmental interaction of state bodies, interaction of state bodies with other organizations, including public associations of disabled people, in the solution of questions of providing the rights of disabled people and their social integration;

participation of public associations of disabled people in forming and implementation of state programs in the field of providing the rights of disabled people and their social integration;

priority of measures for disability prevention.

State policy in the field of providing the rights of disabled people and their social integration is directed on:

providing to disabled people of sales opportunities of the civil, political, economic, social, cultural and other laws and freedoms, equal with other people, enshrined in the Constitution of the Republic of Belarus, this Law, other legal acts and international treaties of the Republic of Belarus;

providing to disabled people of right to education during all life according to needs of the personality, adaptability of education system to level of training, features of development, capabilities and interests;

complete and effective participation of disabled people in life of society;

forming in the society of respect for the rights and advantage of disabled people, drawing attention to their capabilities and contribution to activity of society;

creation of the available circle and improvement of quality of life of disabled people;

creation of living environment taking into account universal design and reasonable adaptation;

enhancement of system of rehabilitation, abilitation and social support of disabled people;

decrease in indicators of frequency and weight of disability.

Article 6. Rights of disabled people

Disabled people in the Republic of Belarus have all completeness of the civil, political, economic, social, cultural and other laws and freedoms enshrined in the Constitution of the Republic of Belarus, this Law, other legal acts and international treaties of the Republic of Belarus including the right on:

nondiscrimination and protection against discrimination on the basis of disability;

independent conduct of life and involvement into public work;

rehabilitation, abilitation;

education;

choice of kind of activity and employment;

participation in political and public life;

available circle;

individual mobility;

use of sign language by disabled people with hearing disorder;

the medical care provided according to the legislation on health care;

provision of premises according to the housing legislation;

sufficient living standards and social support;

participation in cultural life, carrying out leisure and rest, occupation physical culture and sport;

protection and safety in the conditions of emergency situations.

Disabled people have the inalienable right to respect of human dignity irrespective of the state of health.

Handicapped children have all rights and freedoms on an equal basis with other children. In all actions taken concerning handicapped children the best interests of the child shall be provided.

For the purpose of ensuring social integration of disabled people in case of development of technical regulatory legal acts needs of disabled people and need of creation of living environment taking into account universal design and reasonable adaptation are considered.

Article 7. Prohibition of discrimination on the basis of disability

In the Republic of Belarus discrimination on the basis of disability is forbidden.

Discrimination on the basis of disability includes all forms of discrimination, including direct, indirect discrimination, assault and battery, refusal in reasonable adaptation.
