1. Approve the enclosed Rules of subsidizing of expense recovery, suffered by the national company in the field of agro-industrial complex in case of realization of foodgrain for the regulating impact on the domestic market.

2. To provide to department of agriculture of the Ministry of Agriculture of the Republic of Kazakhstan in the procedure established by the legislation:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) placement of this order on Internet resource of the Ministry of Agriculture of the Republic of Kazakhstan after its official publication.

3. To impose control of execution of this order on the supervising vice-Minister of Agriculture of the Republic of Kazakhstan.

4. This order becomes effective after ten calendar days after day of its first official publication and extends to the legal relationship which arose since February 1, 2022.

Rules of subsidizing of expense recovery, suffered by the national company in the field of agro-industrial complex in case of realization of foodgrain for the regulating impact on the domestic market

Chapter 1. General provisions

1. These rules of subsidizing of expense recovery, suffered by the national company in the field of agro-industrial complex in case of realization of foodgrain for the regulating impact on the domestic market (further – Rules) are developed according to subitem 39-1) of Item 1 of article 6 of the Law of the Republic of Kazakhstan "About state regulation of development of agro-industrial complex and the rural territories", the subitem 2) of Item 3 of article 16 of the Law of the Republic of Kazakhstan "About the state statistics" and determine procedure for subsidizing of expense recovery, suffered by the national company in the field of agro-industrial complex in case of realization of foodgrain for the regulating impact on the domestic market.

2. In these rules the following basic concepts are used:

1) authorized body in the field of development of agro-industrial complex (further – authorized body) – the state body performing state regulation in the field of development of agro-industrial complex;

2) the national company in the field of agro-industrial complex – the joint-stock company created according to the decision of the Government of the Republic of Kazakhstan which single shareholder is the state, and participating in ensuring food security by means of implementation of stabilization function in the grain market;

3) foodgrain – the grain used for the food purposes;

4) fixed price – the price for one ton for foodgrain determined by authorized body based on the conclusion of the research organization of agricultural profile following the results of the analysis of statistical data on wheat flour of the first grade;

5) selling price – the minimum estimated selling price for one ton including tax on value added on foodgrain.

3. Foodgrain is implemented by the national company in the field of agro-industrial complex on fixed price to the flour-grinding organizations for production of wheat flour of the first grade by them and realization of wheat flour of the first grade in the domestic market for production of bread of the first grade, wheaten from flour.

4. Foodgrain supply to the flour-grinding organizations for the regulating impact on the domestic market is performed by the national company in the field of agro-industrial complex based on the list of the flour-grinding organizations provided by local executive body of area, city of republican value, the capital (further – local executive body) and the delivery agreements of foodgrain signed between the national company in the field of agro-industrial complex and the flour-grinding organizations according to the Civil code of the Republic of Kazakhstan.

Chapter 2. Procedure for subsidizing of expense recovery, suffered by the national company in the field of agro-industrial complex in case of realization of foodgrain for the regulating impact on the domestic market

5. The national company in the field of agro-industrial complex the difference between selling price and fixed price for one ton of foodgrain is compensated.

6. For receipt of subsidies for expense recovery, the national company in the field of agro-industrial complex monthly to the 5th following month under report sends to local executive body the request for subsidizing of expense recovery, suffered by the national company in the field of agro-industrial complex in case of realization of foodgrain for the regulating impact on the domestic market in form according to appendix 1 to these rules (further – the request).

The following documents are attached to the request:

1) copies of the documents confirming delivery by the national company in the field of agro-industrial complex of foodgrain in flour-grinding the organizations (the copy of the order on realization of foodgrain from the portal of the state electronic register of holders of grain receipts, delivery note on inventory issue aside, the delivery-acceptance certificate);
