1. Approve the enclosed Rules of preserving privileges for retirement benefits for long service to persons whose medical positions are reduced in law-enforcement bodies of the Republic of Kazakhstan since July 1, 2022 and on January 1, 2023, having at the time of reducing position length of service at least twelve years and six months of continuous military service, service in special state and law enforcement agencies, the public courier service, on condition of continuation of work by them in the medical organizations located in pre-trial detention centers and organizations of criminal and executive (penitentiary) system.

2. This resolution becomes effective since July 1, 2022 and is subject to official publication.

Chapter 1. General provisions

1. Rules of preserving privileges for retirement benefits for long service to persons whose medical positions are reduced in law-enforcement bodies of the Republic of Kazakhstan since July 1, 2022 and on January 1, 2023, having at the time of reducing position length of service at least twelve years and six months of continuous military service, service in special state and law enforcement agencies, the public courier service, on condition of continuation of work by them in the medical organizations located in pre-trial detention centers and organizations of criminal and executive (penitentiary) system (further – Rules) are developed according to Item 2-1 of article 64 of the Law of the Republic of Kazakhstan "About provision of pensions in the Republic of Kazakhstan" and determine procedure for preserving privileges for retirement benefits for long service to persons whose medical positions are reduced in law-enforcement bodies of the Republic of Kazakhstan since July 1, 2022 and on January 1, 2023, having at the time of reducing position length of service at least twelve years and six months of continuous military service, service in special state and law enforcement agencies, the public courier service, on condition of continuation of work by them in the medical organizations located in pre-trial detention centers and organizations of criminal and executive (penitentiary) system.

2. Rules extend to persons whose medical positions are reduced, on condition of continuation of work by them in the medical organizations located in pre-trial detention centers and organizations of criminal and executive (penitentiary) system.

Chapter 2. Procedure for preserving retirement benefits for long service to persons whose medical positions are reduced

Persons whose medical positions are reduced are subject to obligatory registration in law-enforcement bodies in the last place of service for date of reducing position in law-enforcement bodies by means of the publication of the relevant order of the head or person replacing it with obligatory specifying of surname, name, middle name (in case of its availability) the employee, the reduced position, monetary pay, special rank, length of service at the time of reducing in law-enforcement bodies based on the statement according to appendix 1 to these rules.

Personnel services based on the order of the head or person replacing it fill in the certificate of registration in duplicate within ten working days (one is issued under list to person whose medical position is reduced, the second is given to the personal record) according to appendix 2 to these rules.

4. Retirement benefits for long service to persons whose medical positions are reduced are appointed in the presence of general working life twenty five and more years from which the continuous military service, service in special state and law enforcement agencies, the public courier service, and redundancy either owing to the state of health, or on reaching the age corresponding to age limit of condition on law-enforcement service on the fixed special rank constitute at least twelve years six months.

5. The size of monetary pay considered for purpose of retirement benefits for long service is confirmed by the cash certificate of the established sample of the relevant financial service on the last place of employment.

6. The right to preserving privileges for retirement benefits for long service for persons whose medical positions are reduced is lost in cases of employee transfer to any other positions which are not positions of the medical organizations located in pre-trial detention centers and organizations of criminal and executive (penitentiary) system.
