About features of lease of the state-owned and municipal property in the period of warlike situation

According to the Law of Ukraine of April 1, 2022 "About introduction of amendments to the Law of Ukraine "About lease of the state-owned and municipal property" the Cabinet of Ministers of Ukraine decides No. 2181-IX:

1. Determine that:

1) to physical persons and physical persons - the entrepreneurs who are called up or accepted for military service after introduction of warlike situation before its termination or cancellation charge of the hire charge of the state-owned and municipal property from 1 date in which they were called or accepted on military service, on 1 date, the passing of military service following in three months after end date by them is not performed.

The fact of appeal or acceptance on military service and the fact of the end of passing of military service proves to be true by sending the adequate notice by the lessee to which the copy military and accounting or other document issued by competent authority that allows to establish start date and/or the ends of passing of military service by it is added.

The specified notification goes to the lessor according to the lease agreement of the state-owned or municipal property in paper or electronic form.

To the lessees determined by paragraph one of this subitem, which:

reported about the beginning of passing of military service by them, but in three months after the termination or cancellation of warlike situation did not report about the termination or prolongation of passing of military service by them, the hire charge of the state-owned and municipal property is charged in full from 1 date following after the third month after the termination or cancellation of warlike situation;

continue to use leased state-owned or municipal property or provided it in use to other persons, the rent is charged in full from 1 date in which by results of control by the asset holder/lessor established fact of such use;

To 1-1) lessees of the state-owned and municipal property located in the territories of active fighting, the territories of active fighting in which the state electronic information resources function or in the territories of Ukraine which are temporarily occupied by the Russian Federation which are included in the list of the territories in which are conducted fighting or temporarily occupied by the Russian Federation, approved by the Ministry of questions of reintegration of temporarily occupied territories (was conducted) (further - certain territories), the rent from 1 date in which start date of fighting or temporary occupation, on 1 date, the completion of fighting following in three months after date or temporary occupation determined according to the specified list was determined rather corresponding territories is not charged;

in the territories of the Kiev, Chernihiv, Sumy, Kharkiv, Zaporizhia, Nikolaev regions and Kiev (except administrative and territorial units in certain territories);

in cultural institutions and educations if object of lease was leased on hourly basis;

3) for warlike situation, but anyway not longer, than till May 30, 2022, according to the lease agreements of state-owned property existing as of February 24, 2022 or prisoners after this date by results of the auctions which took place on February 24, 2022 or earlier lessees who use the property which is in the territories of the Kirovohrad, Dnipropetrovsk, Zhytomyr, Odessa regions are exempted from the rent;
