1. Approve the Procedure for issue of foreign permissions and multilateral permissions to the Kyrgyz automobile carriers according to appendix.

2. This resolution becomes effective after fifteen days from the date of official publication.

Procedure for issue of foreign permissions and multilateral permissions to the Kyrgyz automobile carriers

Chapter 1. General provisions

1. This Procedure for issue of foreign permissions and multilateral permissions to the Kyrgyz automobile carriers (further - the Procedure) is developed according to the Law of the Kyrgyz Republic "About road transport", regulates the procedure of issue of forms of foreign permissions and multilateral permissions to the Kyrgyz automobile carriers (further - carrier) and control of use of forms of the Kyrgyz permissions by foreign carriers.

The procedure is determined by the conventional principles and rules of international law, and also the international treaties which became effective according to the legislation of the Kyrgyz Republic (further - the international agreements).

2. In this Procedure the following concepts are used:

- trip - journey of the vehicle from the point of departure to destination and return back to the point of departure;

- flight - journey of the vehicle from the point of departure to destination;

- transit (transit) - journey of the vehicle with load or without load on the territories of the state, and also the drive of passenger transport in case of which the points of departure and appointments are out of the territory of this state;

- transportation of goods to the third countries / from the third countries - implementation of the international motor freight transportation by the Kyrgyz or foreign carrier from the territory of other state on the territory of the third state and from the territory of the third state on the territory of other state;

- the Kyrgyz carrier is the legal entity and physical person registered in the Kyrgyz Republic having the license of authorized state body in the field of transport (further - authorized body) on implementation of the international motor transportations of loads, passengers and baggage on the territory of foreign state according to international treaties on the international automobile communication between the Kyrgyz Republic and foreign states;

- the foreign carrier is the foreign legal entities and physical persons performing the international motor transportations of loads, passengers and baggage on the territory of the Kyrgyz Republic according to international treaties on the international automobile communication between the Kyrgyz Republic and foreign states;

- the Kyrgyz permission - permission to driving through the territory of the Kyrgyz Republic of foreign carriers according to international treaties;

- foreign permission - the permission to driving through the territory of foreign state issued by authorized body to the Kyrgyz carriers according to international treaties (the universal entry visa, departure, transit, empty drives, and also transportations from the territory of other country on the territory of the third country);

- multilateral permission - permission to driving through the territory of any state which signed the international agreement about multilateral motor transportations issued to carriers of these states, existing during certain time and providing entrance, departure and transit of the vehicle on the territories of any state being the participant of this agreement;

- quota of exchange of forms of the allowing document (further - exchange quota) - the number of the foreign permissions approved for exchange with foreign states;

- international commodity-transport superimposed (CMR) - the carriage document confirming the conclusion of the contract for motor transportation of load and used in case of international carriages of loads by road transport;

- invoice - the international business document provided by the seller to the buyer and containing the inventory, their quantity and the price at which they will be delivered to the buyer, formal features of goods (color, weight, the size, etc.), delivery conditions and the information about the sender and the receiver of loads, goods;

- information system - the electronic program intended for automatic reception of applications, calculation of number of the distributed forms of foreign permission and storage of information about the forms of foreign permission and multilateral permission issued to the Kyrgyz carriers, excluded (cancelled), damaged and lost (further - foreign and multilateral permission), containing information on the used forms of the Kyrgyz permission foreign carriers by results of the transport control which is carried out by authorized body;

- personal account - the portal of the registered Kyrgyz carrier in electronic system of authorized body containing the profile of the Kyrgyz carrier allowing to fill and submit applications, obligation statements, reports to authorized body, and also to receive notifications and preventions from authorized body;
