About some questions of implementation of compulsory insurance of civil responsibility of owners of land vehicles

According to Articles 7, of 15, 55-1, 56 of the Law of Ukraine "About the National Bank of Ukraine", to Articles 21, of 27, 28 Laws of Ukraine "About financial services and state regulation of the markets of financial services", article 36 of the Law of Ukraine "About insurance", to Articles 1, of 7, of 8, of 11, of 33, of 36, 55 Laws of Ukraine "About compulsory insurance of civil responsibility of owners of land vehicles", for the purpose of enhancement of state regulation of activities for compulsory insurance of civil responsibility of owners of land vehicles the Board of the National Bank of Ukraine DECIDES:

1. Approve on representation of Motor (transport) insurance bureau of Ukraine:

1) Regulations on the list, value and procedure for application of adjusting factors in case of the conclusion insurers of agreements of compulsory insurance of civil responsibility of owners of land vehicles which is applied;

2) Regulations on the single centralized database on compulsory insurance of civil responsibility of owners of land vehicles which are applied;

3) the size of basic insurance payment under agreements of compulsory insurance of civil responsibility of owners of land vehicles in the amount of 180 hryvnias;

4) the maximum amount of insurance payment for the harm done to property of the victims in case of document creation about the road accident without participation of representatives on that the staff of National police of Ukraine in the amount of 80000 hryvnias on the victim.

2. Recognize invalid regulatory legal acts of State commission on regulation of the markets of financial services of Ukraine and the National commission performing state regulation in the field of the markets of financial services according to the list which is attached.

3. The resolution becomes effective since July 1, 2022.

Regulations on the list, value and procedure for application of adjusting factors in case of the conclusion insurers of agreements of compulsory insurance of civil responsibility of owners of land vehicles

1. This Provision is developed according to the laws of Ukraine "About the National Bank of Ukraine", "About financial services and state regulation of the markets of financial services", "About insurance", "About compulsory insurance of civil responsibility of owners of land vehicles".

2. Terms in this Provision are used in the values given in the Laws of Ukraine "About insurance", "About compulsory insurance of civil responsibility of owners of land vehicles" (further - the Law).

 3. Requirements of this provision extend to insurers who perform compulsory insurance of civil responsibility of owners of land vehicles and sign agreements on this type of insurance.

4. This Provision determines:

1) procedure and features of application of adjusting factors in case of the conclusion of agreements of compulsory insurance of civil responsibility of owners of land vehicles;

2) the list and value of adjusting factors under agreements of compulsory insurance of civil responsibility of owners of land vehicles;

3) features of application of adjusting factor bonus-malus in case of the conclusion of agreements of compulsory insurance of civil responsibility of owners of land vehicles.

5. The insurer shall apply:

1) the basic insurance payment approved in the subitem 3 of Item 1 of the resolution of Board of the National Bank of Ukraine "About some questions of implementation of compulsory insurance of civil responsibility of owners of land vehicles";

2) adjusting factors and their sizes in the values determined in appendix 1 to this Provision taking into account requirements of Items 7 and 10 of this provision.

6. During calculation of insurance payment of privilege according to Item 13.2 of article 13 of the Law are applied to separate categories of citizens of Ukraine only in the presence of the relevant documents confirming the status and the right of such categories of citizens to privilege.

7. The insurer for encouragement of no-failure operation of vehicles in case of the conclusion of agreements of compulsory insurance of civil responsibility of owners of land vehicles more than has the right to apply adjusting factor depending on availability or lack of insured events because of persons whose responsibility is insured, during operation of the previous contracts to half a year.

8. The insurer who intends to apply adjusting factor bonus-malus shall approve procedure for application of such coefficient and promulgate it on the website (web page) of the insurer on the Internet. The procedure for application of coefficient bonus-malus shall conform to requirements of this provision and Items 8.2 - 8.4 articles 8 of the Law concerning determination of class of the insurer.

9. The insurer in case of modification of procedure for application of coefficient bonus-malus or approvals of new procedure shall promulgate such procedure on own website (web page) in the Internet and the relevant documents at least in 30 calendar days prior to Date of Introduction of such changes or new procedure.

10. The insurer has the right in the presence of the relevant supporting documents at the insurer to apply adjusting factor bonus-malus according to the Scheme of application of adjusting factor bonus-malus in case of the conclusion of agreements of compulsory insurance of civil responsibility of owners of land vehicles according to appendix 2 to this Provision.
