Chapter 1. General provisions

Article 1. Purpose of this Law

The purpose of this Law is regulation of the relations in the field of production, placements and distribution of advertizing (further - advertizing turnover).

Article 2. Coverage of this Law

Operation of this Law extends to all relations in the field of advertizing turnover irrespective of the place of its production if this advertizing is directed to consumption and distribution in the territory of the Republic of Uzbekistan.

Operation of this Law does not extend on:

1) materials of election propaganda;

2) information, disclosure or distribution or bringing to which user is obligatory according to the legislation;

3) the reference and analytical materials (reviews of the internal and external markets, results of scientific research and testing) which do not have as main objective promotion of goods in the market and not being social information;

4) information of the signs and pointers which are not containing data of advertizing nature;

5) declarations of the physical persons or legal entities which are not connected with implementation of business activity;

6) information on goods, his manufacturer, on the importer or the exporter placed on goods or its packaging;

7) any elements of registration of goods placed on goods or its packaging and which are not relating to other goods;

8) references of goods, means of its individualization, of the manufacturer or of the seller of goods which are organically integrated into works of science of literature or arts and in itself are not data of advertizing nature;

9) information on the worldwide information network the Internet about the made or implementable goods posted on the websites of vendors and (or) sellers of goods or on pages on social networks if the specified data are intended for informing visitors of the website or the page on social network about assortment, instructions for use and other characteristics (properties) of implementable goods;

10) results of issue on requests in information retrieval systems on the worldwide information network the Internet.

Article 3. Legislation on advertizing

The legislation on advertizing consists of this Law and other acts of the legislation.

If the international treaty of the Republic of Uzbekistan establishes other rules, than those which are stipulated by the legislation the Republic of Uzbekistan about advertizing then are applied rules of the international treaty.

Article 4. Copyright and related rights to advertizing

Advertizing fully or partially can be object of copyright and the related rights. In this case copyright and the related rights are subject to protection according to the legislation on copyright and the related rights and international treaties of the Republic of Uzbekistan.

Article 5. Basic concepts

In this Law the following basic concepts are applied:

counter-advertizing - the confutation of doubtful advertizing (unfair, obviously false) extended for the purpose of liquidation of the effects caused by it or able to lead to them;

unethical advertizing - advertizing which by use of offensive words, the images and comparisons concerning floor, race, nationality, language, religion, social origin, beliefs, personal and social standing of persons breaks the commonly accepted regulations of humanity and morals encroaches on the objects of art, historical and architectural monuments constituting national or world cultural property discredits the state symbolics (flag, the coat of arms, the anthem), discredits currency of the Republic of Uzbekistan;

social information - information which distribution does not aim direct or mediate profit earning (income), addressed to the indefinite group of people and directed to achievement of the socially useful purposes in spheres of charity and health care, environmental protection, preserving energy resources, prevention of offenses, social protection and safety of the population, spirituality and enlightenment, ensuring interests of society and the state, and also other information of non-commercial nature;

inadequate advertizing - the doubtful, unethical, embedded advertizing, and also other advertizing which is not conforming to requirements of this Law;

doubtful (unfair, obviously false) advertizing - advertizing which as a result of inaccuracy, ambiguity, exaggeration, concealing, violation of requirements for time, the place and method of distribution and other requirements, stipulated by the legislation, enters or can mislead users of advertizing, do loss of property and moral harm to legal entities and physical persons, and also interests of society and state;

the stimulating share - the advertizing performed in the form of holding action, tender, game, inducing users of advertizing to making of certain actions, including condition of participation in which is acquisition of the advertized goods;

advertizing - the special information distributed with use of any advertizing means which contents is addressed to the users of advertizing who are in the territory of the Republic of Uzbekistan, and intended for drawing attention to object of advertizing, forming or maintenance of interest in it, and also its market promotions for the purpose of direct or mediate profit earning (income);

the advertiser - physical person or legal entity, production being the resident or the nonresident of the Republic of Uzbekistan, performing or sale of the advertized goods, or other person, including the sponsor which determined object of advertizing and (or) content of advertizing;

advertizing means - the means used for bringing advertizing to the user of advertizing;

advertizing space (the site area (constructions) of external advertizing and information) - specially selected and (or) taken away territory (soil, asphalt, the green territory and others), certain surface area of the building, construction on which object (construction) of external advertizing and information is established;

the passport of advertizing space - the document issued by Council of Ministers of the Republic of Karakalpakstan, khokimiyats of areas and the city of Tashkent, confirming the right of legal entities and physical persons to placement of objects (constructions) of the external advertizing and information specified in this document on the parcel of land, the building or construction irrespective of form of their property;

the owner of the passport of advertizing space - the legal entity or physical person which acquired the right to placement of object (construction) of external advertizing and information on the parcel of land, the building or construction which is in state-owned property on the basis of open electronic auction through United electronic market place or on the privatized parcels of land, and also buildings or constructions which are in private property - on the basis of the agreement signed with the owner of the privatized parcel of land, buildings or constructions;

object of advertizing - goods to which to drawing attention advertizing, including actions, technologies, means of individualization, results of intellectual activities, and also information on physical persons or legal entities is directed;

advertizing activities - the activities connected with performance of works and services in the field of advertizing turnover;
