About approval of the Regulations on procedure for state registration of genetically engineered animals, grades of genetically engineered plants and strains of nonpathogenic genetically engineered microorganisms

Council of Ministers of the Republic of Belarus DECIDES:

1. Approve Regulations on procedure for state registration of genetically engineered animals, grades of genetically engineered plants and strains of nonpathogenic genetically engineered microorganisms it (is applied).

2. This resolution becomes effective from the date of its official publication.

Regulations on procedure for state registration of genetically engineered animals, grades of genetically engineered plants and strains of nonpathogenic genetically engineered microorganisms

1. This Provision is developed according to the Law of the Republic of Belarus of January 9, 2006 No. 96-Z "About safety of genetically engineered activities" and determines procedure for state registration of genetically engineered animals, grades of genetically engineered plants and strains of the nonpathogenic genetically engineered microorganisms (further – genetically engineered animals, plants and microorganisms) used in the economic purposes.

2. State registration of the genetically engineered animals, plants and microorganisms used in the economic purposes (further – state registration), is performed by the Ministry of Agriculture and Food.

3. For state registration of genetically engineered animals, plants and microorganisms according to this Provision the legal entities and individual entrepreneurs living in the territory of the Republic of Belarus (further – applicants), submit the application in the Ministry of Agriculture and Food.

4. The applicant for state registration of the new genetically engineered animals, plants and microorganisms removed by methods of traditional selection with use as initial material of the genetically engineered animals, plants and microorganisms which are earlier included in the State register of genetically engineered animals, grades of genetically engineered plants and strains of nonpathogenic genetically engineered microorganisms (further – the register), submits the application.

5. The register represents single databank about genetically engineered animals, grades of genetically engineered plants and strains of the nonpathogenic genetically engineered microorganisms used by legal entities and individual entrepreneurs in the economic purposes.

6. The register is kept by the Ministry of Agriculture and Food.

7. Inclusion of genetically engineered animals, plants and microorganisms in the register is performed taking into account recommendations of advisory council about safety of genetically engineered organisms of the Ministry of Natural Resources and Environmental Protection (further – advisory council) about admissibility of use of nonpathogenic genetically engineered organisms in the economic purposes after carrying out testing with observance of safety requirements, the stipulated in Article 15 Laws of the Republic of Belarus "About safety of genetically engineered activities".

State registration of strains of the nonpathogenic genetically engineered microorganisms which are not intended for release to the environment is performed taking into account recommendations of advisory council of admissibility of use of nonpathogenic genetically engineered organisms in the economic purposes by introduction of the data relating to state registration of strains of nonpathogenic genetically engineered microorganisms into the register.

8. The register contains the following data:

registration number of the application submitted for state registration of genetically engineered animals, plants and microorganisms;

name of genetically engineered animals, plants and microorganisms;

year of state registration of genetically engineered animals, plants and microorganisms;

the registration number of the legal entity or individual entrepreneur who submitted the application for state registration of genetically engineered animals, plants and microorganisms, appropriated by the Ministry of Agriculture and Food;

the area of the republic in the territory of which genetically engineered animals, plants and microorganisms are allowed to use in production for the economic purposes;

universal identifier of genetically engineered animals, plants and microorganisms;

genetic characteristic of genetically engineered animals, plants and microorganisms;

economic and biological characteristic of genetically engineered animals, plants and microorganisms.

9. The exception of the register of genetically engineered animals, plants and microorganisms is made in case:

their non-uses in the economic purposes within three last years;

losses of their economic importance;

submissions of data on their adverse influence on health of the person and environment.

10. The exception of the register is performed based on the decision of the Ministry of Agriculture and Food on representation of the state organizations which are under its supervision and other state bodies.

11. Information on inclusion of genetically engineered animals, plants and microorganisms in the register or about their exception of the register is submitted in the public scientific institution "Institute of Genetics and Cytology of National Academy of Sciences of Belarus" within 5 days after adoption of the relevant decision.

12. The register is published annually by the Ministry of Agriculture and Food.

13. No. 405 is excluded according to the Resolution of Council of Ministers of the Republic of Belarus of 19.06.2019

14. Consideration of the application about state registration is carried out by the Ministry of Agriculture and Food to 30-day time from the date of its giving.

15. The Ministry of Agriculture and Food requests independently recommendations of advisory council of admissibility (inadmissibility) of use of nonpathogenic genetically engineered organisms in the economic purposes.

For receipt of recommendations of advisory council of admissibility (inadmissibility) of use of nonpathogenic genetically engineered organisms in the economic purposes the Ministry of Agriculture and Food within three working days from receipt date of the statement for state registration of the genetically engineered animals, plants and microorganisms planned to use in the economic purposes sends to the Ministry of Natural Resources and Environmental Protection the protocol on admissibility (inadmissibility) of release of genetically engineered organisms to the environment for carrying out testing or use in the economic purposes.

The recommendation of advisory council of inadmissibility of use of nonpathogenic genetically engineered organisms in the economic purposes is the basis for refusal in state registration of genetically engineered animals, plants and microorganisms.
