Based on part one of article 40 of the Law of the Republic of Belarus of July 19, 2005 "About telecommunication" the Council of Ministers of the Republic of Belarus DECIDES: No. 45-Z

1. Approve Regulations on procedure for priority use, suspensions or restrictions of use of networks and means of telecommunication in case of emergency situations, introduction of emergency or warlike situation it (is applied).

2. Provide to the Ministry of Communications and Informatization interaction of operators of telecommunication of network of telecommunication public in case of emergency situations, introduction of emergency or warlike situation.

3. This resolution becomes effective from the date of its acceptance.

Regulations on procedure for priority use, suspension or restriction of use of networks and means of telecommunication in case of emergency situations, introduction of emergency or warlike situation

1. This Provision determines procedure for priority use, suspension or restriction of use of networks and means of telecommunication in case of emergency situations, introduction of emergency or warlike situation in the Republic of Belarus.

2. In this Provision the following main terms and their determinations are applied:

priority use of networks and means of telecommunication – the right to use any networks, first-priority in relation to other users, and means of telecommunication;

suspension of use of networks and means of telecommunication – the termination of use of networks and means of telecommunication by other users for the period of the organization and work on mitigations of consequences of emergency situations, effective period of emergency or warlike situation;

restriction of use of networks and means of telecommunication – reducing use of networks and means of telecommunication by other users (change of operating modes of means of telecommunication, amounts of the rendered services of telecommunication) for the period of the organization and work on mitigations of consequences of emergency situations, effective period of emergency or warlike situation.

3. In case of emergency situations the right to priority use, suspension or restriction of use of networks and means of telecommunication have the Ministry of Defence, the Ministry of Emergency Situations, Committee for State Security, Operational analytical center in case of the President of the Republic of Belarus, the Ministry of Internal Affairs, the State boundary committee, the State Customs Committee (further – priority users).

4. Priority use, suspension or restriction of use of networks and means of telecommunication are performed for the purpose of providing priority users with possibility of acceptance of urgent measures for the prevention of emergency situations and liquidation of their effects, ensuring national security, defense and protection of law and order in case of emergency situations, introduction of emergency or warlike situation.

5. In case of emergency situations, introduction of emergency or warlike situation operators of telecommunication under whose authority networks of telecommunication are provide to priority users:

lines of telecommunication;

means of telecommunication, including terminal subscriber devices.

6. In case of emergency situations priority use of networks and means of telecommunication is provided:

the commission on emergency situations under Council of Ministers of the Republic of Belarus;

the commissions on emergency situations of republican state bodies, associations (organizations) subordinated to the Government of the Republic of Belarus;

the commissions on emergency situations under executive and administrative organs of areas and Minsk;

the commissions on emergency situations under executive and administrative organs of areas (cities);

commissions on emergency situations of the organization (object);

the bodies and divisions for emergency situations operating in zones of emergency situations.

7. In case of introduction of emergency state operators of telecommunication provide first of all to law-enforcement bodies, the state security agencies, Operational analytical center in case of the President of the Republic of Belarus, to bodies of the state protection, internal troops, bodies and divisions on emergency situations of network and means of telecommunication, and also render other assistance according to the procedure and on the conditions determined in the act of introduction of emergency state.

8. In case of introduction of warlike situation of network and means of telecommunication it are provided to state bodies, bodies of military management, headquarters of civil defense, local councils of defense first of all according to the legislation on warlike situation.

9. Decisions on suspension or restriction of use of network of telecommunication public are accepted:

Operational analytical center in case of the President of the Republic of Belarus.

10. The decision on suspension or restriction of use of networks and means of telecommunication in case of emergency situations, introduction of emergency or warlike situation is accepted in cases:

lack of available funds of telecommunication for requirements satisfaction of priority users;

need of restriction of traffic for the purpose of prevention of overload in networks of telecommunication;

need of ensuring electromagnetic compatibility during the work of the radio-electronic means involved in zones of emergency situations.

11. The decision on suspension or restriction of use of networks and means of telecommunication in case of emergency situations shall not lead to violation of management of engineering procedures of production from which other emergency situations can result.
