About measures for implementation of the Presidential decree of the Republic of Belarus of February 16, 2012 No. 71

Based on subitem 10.4 of Item 10 of the Regulations on Committee for State Security of the Republic of Belarus approved by the Presidential decree of the Republic of Belarus of July 23, 2013 No. 325, of Item part four 8, of Items 28 and 32 of the Regulations on procedure for licensing of the types of activity connected with specific goods (works, services), No. 71 approved by the Presidential decree of the Republic of Belarus of February 16, 2012 (further – Regulations on licensing), the Committee for State Security of the Republic of Belarus DECIDES:

1. Determine that:

1.1. the statement for issue of the duplicate of special permission (license) for the right of implementation of the activities connected with cryptographic information security and means of secret receipt of information (further, unless otherwise specified, – the license), goes to Committee for State Security (further, unless otherwise specified, – KGB) in form according to appendix 1;

1.2. for consideration of the applications about licensing, prolongation of effective period of the license, introduction in it of change in part of change and (or) amendment of the list of works and (or) services, the list of specific goods concerning which works are performed and (or) services are rendered, and also questions of the termination, suspension, renewal, cancellation of the license, preparation of offers on determination of special licensed requirements and conditions of implementation of the licensed activities in KGB the licensed commission of KGB is created;

1.3. determination of compliance of opportunities of the license applicant (licensee) to licensed requirements and conditions on implementation of the activities connected with cryptographic information security and means of secret receipt of information (further – assessment), is carried out in the cases established by Regulations on licensing.

For evaluating in KGB the commission on check of compliance of opportunities of the license applicant (licensee) to licensed requirements and conditions is created (further – the commission). The purpose of work of the commission is check of reliability of the data containing in the statement and the documents attached to it, availability at the license applicant (licensee) of opportunity to perform the activities connected with cryptographic information security and means of secret receipt of information.

In need of conducting examination of compliance of opportunities of the license applicant (licensee) to licensed requirements and conditions on implementation of the activities connected with cryptographic information security and means of secret receipt of information (further – examination), in KGB the commission taking into account requirements of Items 30-37 of the Regulations on licensing is created.

Assessment and (or) expertize is, as a rule, carried out in the location of the license applicant (licensee) and (or) the rooms used by it for implementation of the licensed activities.

By results of assessment the commission draws up the appraisal report of compliance of opportunities of the license applicant (licensee) to licensed requirements and conditions (further – the appraisal report) with appendix of the materials received by the commission during evaluating. The appraisal report is transferred to approval of the licensed commission of KGB.

If when evaluating expertize was carried out, then results of examination are applied to the appraisal report;

1.4. based on the decision of the licensed commission of KGB the conclusion of KGB about compliance or discrepancy of opportunities of the license applicant (licensee) to licensed requirements and conditions is drawn up;

1.5. KGB keeps the register of special permissions (licenses) for the right of implementation of the activities connected with cryptographic information security and means of secret receipt of information, issued by Committee for State Security on form according to appendix 2 according to the procedure, the established Chapter 8 of the Regulations on licensing.

2. Declare invalid the resolution of Committee for State Security of the Republic of Belarus of April 6, 2012 No. 13 "About some questions of issue of special permissions (licenses) for the right of implementation of the activities connected with cryptographic information security and means of secret receipt of information".

3. This resolution becomes effective after its official publication.
