About estimative activities in the Republic of Belarus

For the purpose of regulation of estimative activities, providing the rights and legitimate interests of citizens and legal entities when evaluating cost of objects of the civil laws, respect for economic interests of the Republic of Belarus and its administrative and territorial units:

1. Determine that:

1.1. The president of the Republic of Belarus determines state policy in the field of estimative activities in the Republic of Belarus;

1.2. The Council of Ministers of the Republic of Belarus realizes state policy in the field of estimative activities, exercises control of activities of republican state bodies in this sphere;

1.3. State committee on property:

keeps the state register of appraisers;

represents the interests of the Republic of Belarus in the international organizations for value assessment of objects of the civil laws;

approves technical codes of common practice in the field of value assessment of objects of the civil laws, except for objects of the civil laws called in subitem 1.7 of this Item and makes explanations concerning value assessment of such objects;

provides interaction and coordination of actions of the republican state bodies and other organizations subordinated to the Government of the Republic of Belarus in the field of estimative activities;

approves Rules of professional appraiser ethic;

performs other powers in the field of value assessment of objects of the civil laws according to the legislation;

1.4. the state register of appraisers is the state information resource and is part of the state information system "State Register of Appraisers" which owner is the State committee on property.

The procedure for use of the specified state information system and procedure for maintaining the state register of appraisers are determined by Council of Ministers of the Republic of Belarus;

1.5. the state register of appraisers includes:

information about the legal entities performing estimative activities including about contractors of examination of reliability of internal assessment and contractors of examination of reliability of independent assessment (further - contractors of examination), and also about the experts who are on the staff of contractors of examination *;

information about the appraisers who received certificates on certification of the appraiser, separately by types of objects of the civil laws;

personal records of appraisers in electronic form;

information on the conclusions about assessment, data from them and electronic copies of these conclusions;

other information determined by Council of Ministers of the Republic of Belarus;

1.6. SUE National Cadastral Agency:

is operator of the state information system "State Register of Appraisers" (further - the operator of the state register of appraisers);

performs program and technical maintenance, upgrade of complex of program technical means of the state information system "State Register of Appraisers";

provides information security, and also accomplishment of other requirements of the legislation on information, informatization and information security in the course of accomplishment of the functions specified in paragraphs second and third to this part.

Financing of expenses on accomplishment of the functions specified in part one of this subitem is performed for the account:

the funds of the republican budget allocated for the property relations, cartography and geodesy to the State committee on property;

other sources according to the legislation;

1.7. The state committee on science and technologies approves technical codes of common practice in the field of value assessment of intellectual property items and property rights on them and makes explanations concerning value assessment of such objects;

1.8. for evaluating cost of objects of the civil laws workers of the legal entity performing estimative activities are subject to certification according to the procedure, determined by Council of Ministers of the Republic of Belarus;

1.9. the independent value assessment of state-owned property is carried out by the state organizations, the organizations which share of state-owned property in authorized fund constitutes more than 50 percent, the organizations performing estimative activities, and also created by the Belarusian Chamber of Commerce and Industry according to appendix 1;

1.10. independent assessment of market value of objects of the civil laws for provision of its results in customs authorities is carried out by contractors of examination, except for local executive and administrative organs, including committees of state-owned property regional both Minsk city executive committees, and public institution "National center of intellectual property";

1.11. the transactions with objects of the civil laws performed without evaluating their cost which obligation is established by the legislation are considered as invalid;
