About beekeeping

The parliament adopts this organic law.

Chapter I. General provisions

Article 1. Subject of the law

Subject of this law is regulation of the relations in the field of beekeeping, protection of the rights of beekeepers, protection of honey bees and conditioning for their rational use for the purpose of product receipt of beekeeping and pollination of entomophilic plants.

Article 2. Law purpose

The purpose of this law is conditioning for increase in quantity and improvement of product quality of beekeeping.

Article 3. Basic concepts

In this law the following basic concepts are used:

beekeeping - the agricultural industry of the livestock sector including content, cultivation and use of honey bees (Apis mellifera) for the purpose of product receipt of beekeeping and pollination of entomophilic plants;

beekeeping products - the products received from colony as result of its life activity namely: honey, wax, propolis, pollen, sting poison, uterine milk, apilarnit, beebread and Merv;

honey - natural product of honey bee which name cannot be used in the name of any other products received in the artificial way;

the beekeeper - person who is going in for beekeeping;

entomophilic plants - the plants pollinated by insects, including bees;

colony - biological unit (colony) of bees consisting of one uterus, variable number of workers, drones, issue and sot;

uterus - female single individual in colony with the developed reproductive organs, capable to copulate with drones and to lay oosperms;

workers - the female individuals with underdeveloped reproductive organs constituting the vast majority in colony and performing throughout life different functions according to job sharing at honey bees;

drone - individual the male (bee) capable to copulate with uterus;

beehive - construction for content of colony;

apiary - set of the beehives with colonies which are compactly placed in certain place with necessary constructions and equipment for occupation beekeeping;

stationary apiary - the apiary placed on the permanent place in place of registration (it is normal in the place of wintering);

nomadic apiary - the apiary transported and placed temporarily, for honey harvest, at source of honey harvest and transported then to other place;

melliferous base (source) - set in certain territory of the entomophillous flora forming nectar and pollen which are natural source of forage for bees;

breed of bees - group (population) of colonies of general origin, rather numerous for cultivation "in", created by the person by selection method in certain edaphic-climatic conditions and having characteristic phenotypical and genotypic signs;

breeding colonies - the thoroughbred colonies with high productive rates which are steadily descending the breeding qualities;

breeding apiary - apiary with breeding colonies that is confirmed with documentary zootechnical accounting, received the state certification according to the current legislation;

the passport of apiary - the document (form No. 2 Ares) approved by the Ministry of Agriculture and the food industry and issued by the National agency on safety of foodstuff in which are specified the owner of apiary, its legal address, place of registration of the permanent location of apiary, number of colonies, breed, results state zootechnical and sanitary veterinary supervision, terms and nature of the held preventive and medical events for fight against diseases of bees, addresses of placement of apiary on migration;

the breeding certificate of queen - the document (form No. 1-Ap) approved and issued by the Ministry of Agriculture and the food industry on breeding uterus, held for sale;

the certificate of breeding stock-rearing farm (apiary) - the document (form) approved by the Ministry of Agriculture and the food industry and issued by the National agency on safety of foodstuff according to the Law on breeding case in livestock production N 371-XIII of February 15, 1995;

genetic material - biological material, the carrier of heritable genes (queens, swarm with uterus, drones, sperm, eggs, larvae) which can be used for the purpose of reproduction;

appraisal of quality - determination of breeding value (class) of colonies on the basis of their assessment by complex of the morfo-productive and biological characters registered in documents of zootechnical accounting.

Article 4. Legal regulation in the field of beekeeping

(1) the Relations in the field of beekeeping are governed by this law, others legislative and regulations, and also international treaties, one of the parties of which is the Republic of Moldova.

(2) If international treaties, one of the parties of which is the Republic of Moldova, other provisions than provided present by the law are established, provisions of international treaties are applied.

Chapter II. Rights and obligations of beekeepers

Article 5. Subjects of activities in the field of beekeeping

In the field of beekeeping any physical person or legal entity having knowledge necessary for this purpose and respecting the rules and rules of activities in this area can be engaged in activities.

Article 6. Beekeeper's rights

The beekeeper has the right:

a) practice cultivation of the breeds of bees zoned in the Republic of Moldova;

b) ask at bodies of the public power and owners of the parcels of land permission (consent) to placement of apiary to migration;

c) collect the bee swarm which took off from own apiary and settled on others site in case of its continuous pursuit, at the same time the owner of this site has no right to collect the specified swarm;

d) collect the found neglected bee swarm and place it on own apiary with the right of further ownership of it;

e) require according to the current legislation of indemnification, put to it with physical persons or legal entities;

f) ceased to be valid according to the Law of the Republic of Moldova of 20.10.2017 No. 215

g) combine with other beekeepers for creation of different associations of beekeepers according to provisions of the Law on groups of agricultural producers and their associations No. 312/2013 and the Law on public associations No. 837/1996.

Article 7. Beekeeper's obligations

The beekeeper shall:

a) register the address of stationary apiary, quantity of colonies, and also the address of the owner of apiary in primeriya;

b) to be registered temporarily in body of local public authority of the first level in which subordinated territory the apiary on migration, with indication of passport number of apiary, name/name of the owner of apiary, name of the responsible person, number of the stationary and/or mobile phone, the location of apiary on migration is located;
