RESOLUTION OF THE CABINET OF MINISTERS OF UKRAINE

Some questions of holding actions of the state control of compliance with law of foodstuff, sterns, by-products of animal origin, health and wellbeing of animals, the state veterinary health control and cargo importation on customs area of Ukraine in the period of warlike situation

According to Item 6-1 of the Section X "Final and transitional provisions" of the Law of Ukraine "About the state control of compliance with law about foodstuff, sterns, by-products of animal origin, health and wellbeing of animals" and Item 3-1 of the Section XVII "Final provisions" of the Law of Ukraine "About veterinary medicine" the Cabinet of Ministers of Ukraine decides:

1. Determine that for warlike situation of measure of the state control of compliance with law about foodstuff, sterns, by-products of animal origin, health and wellbeing of animals are carried out taking into account the following features:

measures of the state control at check points on frontier of Ukraine and in customs control zones on customs area of Ukraine are carried out in the presence of opportunities (conditions) for their carrying out;

in case of cargo importation with products events of the state control are held in the form of documentary check and check of compliance on frontier, except freights with products which are subject to physical control on frontier and to laboratory researches (testing) in the cases determined by Items 1, 2 and 4 parts one of article 45 of the Law of Ukraine "About the state control of compliance with law about foodstuff, sterns, by-products of animal origin, health and wellbeing of animals";

in case of cargo importation with foodstuff of not animal origin and sterns of not animal origin events of the state control are held in the form of documentary check, except freights which are subject to check of compliance on frontier, physical control on frontier and to laboratory researches (testing) in the cases determined by Items 1, 2 and 4 parts one of article 45 of the Law of Ukraine "About the state control of compliance with law about foodstuff, sterns, by-products of animal origin, health and wellbeing of animals" and in case such freights are included in the list of foodstuff of not animal origin and forages of not animal origin with freights when which importing (transfer) to customs area of Ukraine are subject to the strengthened state control, No. 158 approved by the order of the Ministry of Agricultural Policy and Food of March 26, 2018.

2. Determine that for warlike situation events of the state veterinary health control are held taking into account the following features:

in case of import of veterinary medicines events of the state veterinary health control are held based on information on availability in the State register of veterinary medicines approved by Public service on safety issues of foodstuff and consumer protections, medicines which are imported;

in case of import of substances for production of veterinary medicines events of the state veterinary health control are held based on information on availability in the State register of veterinary medicines approved by Public service on safety issues of foodstuff and consumer protections, veterinary medicines for which production substances, and also information from the leaflet insert (instruction) to the specified veterinary medicines that substances which are imported are their part are imported.

3. Determine that for warlike situation cargo importation on customs area of Ukraine is allowed taking into account such features:

cargo importation with products from the states concerning which restrictions in connection with flash in their territory of the diseases entered in the list of diseases approved by the World Health Organization of animal (MEB), or other diseases which pose threat for the health of the person and/or animal determined by the legislation of Ukraine or the international legislation were introduced is allowed provided that such products were rather processed that guarantees destruction of the causative agent of the corresponding diseases, freights with products are followed by the appropriate international certificate and other documents (the declaration of the producer, guarantee of competent authority of country of source) certifying method of processing of product and guarantee its compliance to the processing methods (destroying the causative agent of the corresponding diseases), determined in the instructions for prevention and fight against diseases approved according to the legislation and/or in the Code of land animals of the World Health Organization of animal (MEB);

cargo importation with feed additives without their state registration in Ukraine is allowed provided that such additives are registered (are permitted) in the European Union and intended for production of forages for productive animals;

cargo importation with the packed-up (packed) sterns for productive animals made with use of the feed additives registered and permitted in the European Union is allowed provided that such forages it is from the capacities located in member states of the European Union or in other states provided that capacities in such states have the import permit of forages to the European Union;

cargo importation with productive animals and genetic material from them from capacities concerning which compliance to the legislation of Ukraine is not established, it is allowed provided that such freights are imported (are sent) on customs area of Ukraine from the states concerning which capacities within two years about day of entry into force of this resolution their compliance to the legislation of Ukraine, and taking into account epizootic situation in the State of origin of freight was established;

cargo importation with productive animals and genetic material from them in case of their transit through the territory of the states where availability of especially dangerous disease entered in the list of diseases approved by the World Health Organization of animal (MEB) to which such animals are susceptible is confirmed is allowed provided that such freights were unloaded and/or overloaded in the territory of the specified states.

4. This resolution becomes effective from the date of its publication.
