1. Approve Regulations on procedure for carrying out tender on selection of realtor and other specialized organizations for carrying out biddings according to appendix.

2. To management of state registration of departmental regulations (S. Sattarov):

register this order and enter the corresponding record in the State register of regulations of the ministries, state committees and departments;

provide control of the correct application and bringing to data of interested persons of requirements of this provision.

3. This order becomes effective after ten days from the date of its state registration in the Ministry of Justice of the Republic of Uzbekistan.

4. To provide to department on execution of judgments, material and financial provision of activity of the courts (Z.Khudaykulov) within 10 days bringing this order to territorial administrations of Department for execution and management.

5. (U. Ayubov) to provide to management of systematization of the legislation and legal information publication of this order in "Collection of the legislation of the Republic of Uzbekistan" - "Uzbekiston Respublikasi Konun of tuplama huzhzhatlara".

6. To impose control over the implementation of this order on the deputy minister E. Kanyazov.

Regulations on procedure for carrying out tender on selection of realtor and other specialized organizations for carrying out biddings

I. General provisions

1. According to the resolution of the President of the Republic of Uzbekistan of August 31, 2006 realization according to executive documents of automotor-vehicles is performed No. PP-458, only on the open biddings held by specialized trade organizations, and real estate, including the parcel of land (which is object of the property right of physical persons and legal entities), object of construction in progress - on the open biddings held by the realtor organizations.

2. Selection of organizers of the biddings on realization of automotor-vehicles and real estate in case of execution of court resolutions and acts of other bodies is made for carrying out biddings in central office of the Ministry of Justice of the Republic of Uzbekistan on competitive basis.

3. Competition is held separately on each region of the Republic of Uzbekistan (The Republic of Karakalpakstan, areas and the city of Tashkent).

4. The purpose of carrying out tender is identification of the optimum organizer of the biddings for realization of automotor-vehicles and real estate. In necessary cases, considering amount of the automotor-vehicles realized according to executive documents and real estate, in each region on the basis of tender several organizers of the biddings which are assigned to specific district (city) departments of legal executives can be determined or specialize on realization of one type of property (the automotor-vehicle or real estate).

5. The basic principles of the organization of carrying out tender are creation of equal competitive conditions for all participants of tender, publicity, objectivity of assessment and unity of requirements.

6. Tender is open in which the organizers of the biddings registered in accordance with the established procedure can take part.

At the same time the realtor organizations shall have the license for the right of implementation of realtor activities, and in the charter of specialized trade organization shall be specified about activities for the organization of biddings for realization of automotor-vehicles.

II. Procedure for the organization and carrying out tender

7. Competition is held by the tender committee (further - the Commission) acting on the permanent basis.

8. The commission consists of five members: representatives of the Ministry of Justice, Ministry of Finance, State committee of the Republic of Uzbekistan on privatization, demonopolization and development of the competition, head of department of execution of judgments and chief of Inspection of own safety of Judicial department.

The staff of the Commission affirms the order of the Minister of Justice of the Republic of Uzbekistan.

9. The organization of carrying out tenders is assigned to working body of the Commission - department of execution of decisions of tax, customs and other authorities of Judicial department.

10. Commission:

makes the decision on carrying out tender, date of its carrying out;

exercises control over activities of working body;

defines the winner (winners) of tender;

makes the recommendation of the conclusion of the agreement with the winner (winners) of tender.

11. Working body:

places the announcement in mass media of carrying out tender;

acquaints applicants with tender conditions;

adopts statements and provides their accounting, safety and confidentiality.

12. Commission session is competent with the assistance of most of his members.

13. The commission at least in thirty days prior to carrying out tender places the announcement in mass media of carrying out tender.

14. The announcement shall contain the following information:

name of working body;

tender subject;

date, time and venue of tender;
